Coogan v. Genuine Parts Co.
Doy Coogan died of peritoneal mesothelioma after years of asbestos exposure through his automotive repair work and excavation business. A jury unanimously found Genuine Parts Company (GPC) and National Automotive Parts Association (NAPA) liable for Coogan’s wrongful death and entered an $81.5 million verdict for his family and estate. GPC and NAPA moved for a new trial or alternatively a remittitur of damages, which the trial court denied. The Court of Appeals reversed the trial court in part and vacated the jury’s damages award. Though it rejected claims for a new trial premised on alleged misconduct by plaintiff’s counsel, it concluded that the trial court erred by excluding one of GPC and NAPA’s expert witnesses and that the jury’s award was excessive. Specifically, the Court of Appeals rejected the jury’s award of noneconomic damages in favor of its own “necessarily . . . subjective” determination that the amount of damages was “so excessive that it shock[ed] the court’s conscience.” The Washington Supreme Court granted review to address the appropriate standards for reviewing post-trial motions to set aside jury verdicts. "While appellate review serves an essential purpose in safeguarding the integrity of the jury process, it must remain limited." The Court concluded the Court of Appeals overstepped its limited role and inappropriately substituted its own judgment for that of the trial court and the jury. Conway Constr. Co. v. City of Puyallup
The city of Puyallup (City) hired Conway Construction Company to build a road. The contract allowed the City to terminate the contract early either for its convenience or on Conway’s default, but a termination for convenience would result in more costs for the City. The City ended up terminating the contract partway through construction, claiming Conway defaulted. After a lengthy bench trial, the trial court concluded that Conway was not in default when the City terminated the contract and converted the termination into one for convenience. After review, the Washington Supreme Court affirmed the trial court’s decision. Further, the Court held that the City was not entitled to an offset for any defective work discovered after termination because the City did not provide Conway with the contractually required notice and opportunity to cure. Green v. Pierce County
The issue before the Washington Supreme Court’s in this case was whether an individual’s YouTube channel qualified as “news media” for requests for certain records under the Washington Public Records Act (PRA). In 2014, Brian Green and Peter Auvil went to the County-City Building in Tacoma to file a document and pay a parking ticket. As they went through security, the guard asked to search Auvil’s bag. Auvil refused. A Pierce County deputy sheriff came to assist, and Auvil began to record a video of the interaction on his phone. Auvil continued to refuse to allow the security guard to search the bag, arguing that the security checkpoint was a violation of his privacy rights. The conversation escalated, and the deputy asked the men to leave. When Green stood too close to him, the deputy shoved Green and caused him to fall backward onto the floor. The deputy arrested Green for criminal obstruction and took him to jail. He was released approximately 24 hours later. The prosecuting attorney’s office dismissed the charge. In December 2017, Green e-mailed a PRA request to the Pierce County Sheriff’s public records office requesting “[a]ny and all records of official photos and/or birth date and/or rank and/or position and/or badge number and/or date hired and/or ID Badge for all detention center and/or jail personnel and/or deputies on duty November 26 & 27 2014.” A representative of the Sheriff’s “Public Disclosure Unit” sent 11 pages of records, but did not include photographs or dates of birth as requested, explaining that the information was exempt under the PRA. Green said he was “working on a story concerning the Pierce County Jail” and again signed his e-mail with the title, “Investigative Journalist.” Green claimed his 6,000-subscriber YouTube channel met the definition of “news media” under the PRA. The Supreme Court concluded the statutory definition of “news media” required an entity with a legal identity separate from the individual. Green did not prove that he or the Libertys Champion YouTube channel met the statutory definition of “news media,” and, thus, he was not entitled to the exempt records. Therefore, the trial court was reversed in part. The Court affirmed the trial court’s denial of Pierce County’s motion to compel discovery. View "Green v. Pierce County" on Justia Law
Johnson v. Liquor & Cannabis Bd.
On a rainy day in 2011, Darcy Johnson, a business invitee at a Washington State Liquor Control Board liquor store, slipped and fell in the entryway to that store, just after entering. A jury returned a verdict for Johnson. The Court of Appeals reversed, reasoning that the trial court should have granted the State’s motion for a judgment as a matter of law because Johnson had not satisfied the notice requirement in a premises liability action. The Washington Supreme Court granted review to resolve whether the reasonable foreseeability exception to the notice requirement applied. The Court held that the exception applied. Saralegui Blanco v. Gonzalez Sandoval
This case involved a premises liability claim brought by a visitor against landlords for an injury caused by the tenants’ dog. The question was whether the landlords, Ernesto and Teri Hernandez, owed a duty to petitioner Maria Saralegui Blanco. The tenants, David Gonzalez Sandoval, Alexandra Barajas Gonzalez, and Elvia Sandoval, rented single family home owned by the landlords. While visiting the home, Saralegui Blanco was attacked and bitten by the tenants’ dog. Saralegui Blanco sued, alleging the tenants and landlords were negligent and liable for her injuries. The trial court dismissed the claims against the landlords on summary judgment. The Washington Supreme Court granted direct review and affirmed the trial court’s grant of summary judgment, dismissing Saralegui Blanco’s premises liability claim against the landlords: petitioner failed to establish a genuine issue of material fact that the landlords possessed the land, retained control over the premises or the dog, or created a dangerous condition. In re Recall of Sawant
Kshama Sawant served on the Seattle City Council since 2013. Ernest Lou, among others, filed recall charges alleging that Councilmember Sawant delegated city employment decisions to a political organization outside city government, used city resources to promote a ballot initiative and failed to comply with public disclosure requirements, disregarded state orders related to COVID-19 and endangered the safety of city workers and other individuals by admitting hundreds of people into Seattle City Hall while it was closed to the public, and led a protest march to Mayor Jenny Durkan’s private residence, the location of which Councilmember Sawant knew was protected under state confidentiality laws. The trial court found these charges factually and legally sufficient for recall. Councilmember Sawant challenged the ballot synopsis. The Washington Supreme Court determined petitioner’s charges that Councilmember Sawant delegated city employment decisions to a political organization outside city government and a portion of the charge that Councilmember Sawant’s actions in divulging the location of Mayor Durkan’s private residence amounted to criminal harassment in violation of RCW 9A.46.020 were legally insufficient. The Court affirmed in all other respects, and declined to address the Councilmember's challenge to the ballot synopsis, because RCW 29A.56.140 provided that “[a]ny decision regarding the ballot synopsis by the superior court is final.” View "In re Recall of Sawant" on Justia Law
Hester v. Washington
This case involved a challenge to former RCW 43.43.120(23)(a) (2001), which excluded certain overtime from the calculation of the monthly pension benefit granted under the Washington State Patrol Retirement System (WSPRS). Four Washington State troopers (Troopers) hired before the statute became effective claimed this exclusion of voluntary overtime from the calculation of their monthly pensions was an unconstitutional impairment of their contract with the State in violation of article I, section 10 of the United States Constitution and article I, section 23 of the Washington State Constitution. On cross motions for summary judgment, the trial court ruled: (1) the statute of limitations was three years and accrued at retirement; (2) there remained issues of material fact regarding whether the change was offset by comparable benefits; and (3) the change was reasonable and necessary to serve a legitimate public purpose. After review of that ruling, the Washington Supreme Court affirmed the trial court’s rulings on the statute of limitations and on comparable benefits. However, the Court vacated its legitimate public purpose ruling as premature given that the issue of comparable benefits remained for trial. The matter was remanded for additional proceedings. Woods v. Seattle’s Union Gospel Mission
The issue in this case was whether the Washington legislature extended a privilege or immunity to religious and other nonprofit, secular employers and whether, in providing the privilege or immunity, the legislature affected a fundamental right without a reasonable basis for doing so. Lawmakers enacted Washington’s Law Against Discrimination (WLAD) to protect citizens from discrimination in employment, and exempted religious nonprofits from the definition of “employer.” In enacting WLAD, the legislature created a statutory right for employees to be free from discrimination in the workplace while allowing employers to retain their constitutional right, as constrained by state and federal case law, to choose workers who reflect the employers’ beliefs when hiring ministers. Matthew Woods brought an employment discrimination action against Seattle’s Union Gospel Mission (SUGM). At trial, SUGM successfully moved for summary judgment pursuant to RCW 49.60.040(11)’s religious employer exemption. Woods appealed to the Washington Supreme Court, contesting the constitutionality of the statute. SUGM argued RCW 49.60.040(11)’s exemption applied to its hiring decisions because its employees were expected to minister to their clients. Under Our Lady of Guadalupe School v. Morrissey-Berru, 140 S. Ct. 2049 (2020), plaintiff’s employment discrimination claim must yield in a few limited circumstances, including where the employee in question was a minister. Whether ministerial responsibilities and functions discussed in Our Lady of Guadalupe were present in Woods’ case was not decided below. The Supreme Court determined RCW 49.60.040(11) was constitutional but could be constitutionally invalid as applied to Woods. Accordingly, judgment was reversed and the case remanded to the trial court to determine whether SUGM met the ministerial exception. View "Woods v. Seattle's Union Gospel Mission" on Justia Law
Meyers v. Ferndale Sch. Dist.
Gabriel Anderson, a student of the Ferndale School District (Ferndale), was killed by a vehicle while on an off campus walk with his physical education (PE) class. Anderson’s estate alleged negligence by Ferndale. The trial court dismissed the claim, granting Ferndale summary judgment based on a lack of duty. The Court of Appeals reversed, determining that there were sufficient factual issues on duty and proximate causation. Ferndale challenged the Court of Appeals’ analysis of proximate cause. The issue presented for the Washington Supreme Court's review was whether Ferndale was entitled to summary judgment dismissal based on proximate causation. While the Court of Appeals erred in analyzing legal causation, the Supreme Court found it properly concluded that material issues of fact existed concerning proximate causation. The Supreme Court therefore affirmed the Court of Appeals’ decision to reverse summary judgment dismissal of the negligence claim against Ferndale. View "Meyers v. Ferndale Sch. Dist." on Justia Law
Freedom Found. v. Teamsters Local 117
The Freedom Foundation was a nonprofit organization that describes itself as committed to “advanc[ing] individual liberty, free enterprise and limited, accountable government in the Evergreen State.” The Foundation brought citizen’s actions against Teamsters Local 117; Service Employees International Union Political Education and Action Fund (SEIU PEAF); and Governor Inslee, the Department of Social and Health Services, and Service Employees International Union 775 for various alleged violations of Washington’s Fair Campaign Practices Act (FCPA). In consolidated appeals, the issue common to all was whether the Freedom Foundation satisfied the FCPA’s prerequisites before filing their citizen’s actions. In each case, the superior courts ruled the Foundation failed to meet a 10-day deadline required by the FCPA and, accordingly, entered judgment for respondents. After review, the Washington Supreme Court agreed and affirmed. With respect to the Foundation's suit against the Teamsters Local 117, the Supreme Court determined that though the superior court erred by granting judgment on the pleadings to the union, the court’s entry of judgment would have been proper as summary judgment, and was thus affirmed. This result precluded the Foundation’s other challenges to the superior court’s rulings, which were therefore not addressed. As to the union's cross-appeal of its counterclaim against the Foundation under 42 U.S.C. 1983, the Foundation was not a state actor, was not wielding powers traditionally and exclusively reserved to the State, and therefore was not subject to suit under section 1983.
