Bunn v. Perdue
In January 2011, plaintiff-appellant Virgin Bunn was hired for a one-year probationary period as a human resources assistant at the United States Forest Service’s (“USFS”) Albuquerque Service Center. Ten months into the job, Bunn's supervisor became concerned about Bunn's job performance. After his supervisor asked a colleague to oversee Bunn’s work, Bunn complained to his supervisor about the colleague’s comments to him. Bunn later contacted USFS’s Equal Employment Opportunity (“EEO”) Counselor Office about these comments. On January 6, 2012, Bunn was fired. Bunn thereafter filed an EEO complaint with the United States Equal Employment Opportunity Commission (“EEOC”) alleging harassment, a hostile work environment, and retaliation. An administrative law judge dismissed the suit, granting summary judgment to the agency on all claims. The USDA’s Office of Adjudication issued a final order implementing the EEOC’s decision. Bunn appealed. The Office of Federal Operations affirmed the USDA’s final decision. After its review of the matter, the Tenth Circuit Court of Appeals found: Bunn's appeal of the summary judgment order was untimely; and (2) there was no reversible error in the district court's order striking Bunn's motion to vacate. Frappied v. Affinity Gaming Black Hawk
Plaintiffs alleged defendant Affinity Gaming Black Hawk, LLC (“Affinity”) terminated them on the basis of age and sex. They brought disparate impact and disparate treatment claims under Title VII of the Civil Rights Act of 1964 and the Age Discrimination in Employment Act (“ADEA”). The district court dismissed (1) the Title VII disparate impact claim, (2) the Title VII disparate treatment claim, and (3) the ADEA disparate impact claim. It granted summary judgment in favor of Affinity on the ADEA disparate treatment claim. After review, the Tenth Circuit affirmed dismissal of the Title VII disparate treatment claim. With respect to the other claims, the Court reversed and remanded to the district court, finding that when the evidence was construed in the light most favorable to plaintiffs, it sufficed to create a genuine issue of material facts with respect to the other allegations. Zahourek Systems v. Balanced Body University
These appeals involves a sculptural work called “the Maniken,” which portrays the human body. The defendant, Balanced Body University, bought several Manikens and used them to advertise and instruct students on human anatomy. Jon Zahourek and his company Zahourek Systems, Inc., sued for copyright infringement (among other claims). The district court granted summary judgment to Balanced Body University on the copyright-infringement claim, concluding that the Maniken was unprotected as a “useful article.” If the Maniken was a useful article, it wouldn’t ordinarily be protectible under the copyright laws. The Tenth Circuit concluded that a genuine issue of material fact existed on whether the Maniken was a useful article. View "Zahourek Systems v. Balanced Body University" on Justia Law
Boulder County Commissioners v. Suncor Energy
The issue this case presented for the Tenth Circuit's review centered on whether federal court was the proper forum for a suit filed in Colorado state court by local governmental entities for the global warming-related damage allegedly caused by oil and gas companies in Colorado. Suncor Energy and ExxonMobil advanced seven bases for federal subject matter jurisdiction in removing the action to federal court, each of which the district court rejected in its remand order. Suncor Energy and ExxonMobil appealed, reiterating six of those bases for federal jurisdiction. After review, the Tenth Circuit held that 28 U.S.C. 1447(d) limited its appellate jurisdiction to just one of them: federal officer removal under 28 U.S.C. 1442(a)(1). And because the Court concluded ExxonMobil failed to establish grounds for federal officer removal, the Court affirmed the district court’s order on that basis and dismissed the remainder of this appeal. Kapinski v. City of Albuquerque
Anthony Kapinski shot and killed two men for which he was arrested and prosecuted for murder. But at trial, the jury found him not guilty on the basis of self-defense. Trial evidence included video surveillance footage of the incident. Kapinski brought civil rights claims under 42 U.S.C. 1983 against Detective Terra Juarez and the City of Albuquerque, alleging constitutional violations stemming from Detective Juarez’s failure to mention the video surveillance footage in her warrant affidavit for Kapinski’s arrest. He argued that if the court issuing the arrest warrant had been made aware of the video footage, it would not have found probable cause supporting the warrant. Detective Juarez moved for summary judgment on qualified immunity grounds, and the district court granted her motion. The court held Kapinski failed to show a constitutional violation because the video footage would not have negated probable cause for his arrest, and, even if Detective Juarez’s omission ran afoul of the Fourth Amendment, she was nonetheless entitled to summary judgment because the law on this issue was not clearly established. To this, the Tenth Circuit agreed Kapinski failed to show a clearly established constitutional violation and therefore affirmed summary judgment. View "Kapinski v. City of Albuquerque" on Justia Law
Sierra Club v. EPA
The issue this case presented for the Tenth Circuit's review involved an interpretation of an environmental regulation addressing the renewal of permits under Title V of the Clean Air Act. The statute and accompanying regulation allowed renewal of these permits only if they ensured “compliance with” all of the “applicable requirements.” The term “applicable requirements” was defined in the regulation, but not the statute. The Sierra Club interpreted the regulatory definition to require compliance with all existing statutory requirements; the EPA interpretd the regulatory definition more narrowly, arguing that the applicability of certain requirements was determined by the state permit issued under a separate part of the Clean Air Act (Title I). The Tenth Circuit agreed with the Sierra Club’s interpretation: the regulatory definition of “applicable requirements” included all requirements in the state’s implementation plan, and Utah’s implementation plan broadly required compliance with the Clean Air Act. So, the Court concluded, all of the Act’s requirements constituted “applicable requirements” under the regulation. View "Sierra Club v. EPA" on Justia Law
United States v. RaPower-3
In 2015, the Government filed a civil action against Neldon Johnson, Gregory Shepard, and Johnson’s three companies: RaPower-3 LLC (“RaPower”), International Automated Systems, Inc. (“IAS”), and LTB1, LLC (“LTB”) (collectively, Defendants). The Government alleged Defendants promoted an abusive tax scheme. Following a bench trial, the district court found for the Government, enjoined the Defendants from further promoting their scheme, and ordered disgorgement of ill-gotten gains. In 2018, the district court appointed a receiver (Appellee) to take control of Defendants' assets and to investigate whether their affiliated entities possessed proceeds from the illicit tax scheme. On the Receiver’s recommendation, the court added 13 nonparty affiliated entities to the Receivership. Six of the added entities (“Appellant Entities”) appeals, arguing the district court included them in the Receivership without providing sufficient due process. Finding the "Receivership Expansion Order" was not immediately appealable because the Appellant Entities did not show the order was final, the Tenth Circuit dismissed the appeal for lack of jurisdiction. Carr v. Commissioner, SSA
In separate claims, appellees Willie Carr and Kim Minor sought disability benefits from the Social Security Administration (“SSA”). In each case, the administrative law judge (“ALJ”) denied the claim, and the agency’s Appeals Council declined to review. While his case was pending in district court, the U.S. Supreme Court held that Securities and Exchange Commission (“SEC”) ALJs were “inferior officers” under the Appointments Clause, and therefore must be appointed by the President, a court, or head of the agency. Shortly thereafter, Minor also sued in district court to challenge the denial of benefits in her case. In response to the Supreme Court case, Lucia v. S.E.C., 138 S. Ct. 2044 (2018), the SSA Commissioner appointed the SSA's ALJs to address any Appointments Clause questions Lucia posed. After the Commissioner’s action, Carr and Minor each filed a supplemental brief, asserting for the first time that the ALJs who had rejected their claims had not been properly appointed under the Appointments Clause. The district court upheld the ALJs’ denials of the claims, but it agreed with the Appointments Clause challenges. The court vacated the SSA decisions and remanded for new hearings before constitutionally appointed ALJs. It held that appellees did not waive their Appointments Clause challenges by failing to raise them in their SSA proceedings.
On appeal, the Commissioner argued Appellees waived their Appointments Clause challenges by failing to exhaust them before the SSA. The Tenth Circuit agreed with the Commissioner and reversed. View "Carr v. Commissioner, SSA" on Justia Law
Wild Watershed v. Hurlocker
The United States Forest Service approved two forest thinning projects in the Santa Fe National Forest pursuant to authority granted by a 2014 amendment to the Healthy Forests Restoration Act (HFRA). By thinning the forest and then conducting prescribed burns in the project areas, the Forest Service sought to reduce the risk of high-intensity wildfires and tree mortality related to insects and disease. Certain environmental organizations and individuals (collectively Wild Watershed) challenged the projects’ approval under the Administrative Procedure Act (APA), asserting the Forest Service failed to comply with the National Environmental Policy Act (NEPA) and HFRA. The district court rejected these claims, and the Tenth Circuit concurred, finding the Forest Service adequately considered the projects’ cumulative impacts as well as their potential effects on sensitive species in the area and the development of old growth forest. Platt v. Winnebago Industries
Deborah and Dallas Platt purchased a 2016 Winnebago Era RV in 2016. This purchase was subject to Winnebago’s New Vehicle Limited Warranty, which required the Platts to bring the RV for repairs to an authorized dealer and then, if those repairs were insufficient, to Winnebago itself before they could bring an action against Winnebago. The RV suffered from a litany of defects and the Platts took it in for warranty repairs to Camping World of Golden, Colorado (Camping World), an authorized Winnebago dealership, on numerous occasions for numerous separate defects within the first seven and a half months of their ownership. When the Camping World repairs did not resolve the Platts’ issues with the RV, they scheduled an appointment for repairs with Winnebago in Forest City, Iowa, but they subsequently cancelled the appointment, claiming they had "lost faith" that Winnebago would repair their RV. The Platts sued Winnebago for breach of express and implied warranties under both the Magnuson-Moss Warranty Act and Colorado state law, and also for deceptive trade practices in violation of the Colorado Consumer Protection Act (CCPA). Winnebago filed a motion for summary judgment which the district court granted, dismissing all of the Platts’ claims. The Platts appealed, but finding no reversible error, the Tenth Circuit affirmed.
