Ex parte Road Gear Truck Equipment, LLC.
Road Gear Truck Equipment, LLC ("Road Gear"), a corporation based in Franklin County, petitions this Court for a writ of mandamus directing the Marshall Circuit Court to vacate its order denying Road Gear's motion to transfer the underlying action to the Franklin Circuit Court and to enter an order transferring the action. Road Gear manufactures trucking equipment, including "cab guards" designed to prevent passengers in tractor-trailer trucks from being injured by shifting loads. Vernon Dement was operating a tractor trailer pulling a load of logs in Madison County, Alabama. While traveling, Dement's truck over turned on a curve in the road. The cargo crashed into the passenger compartment, crushing Dement to death inside the vehicle, and injuring his wife Deborah Dement, who was a passenger in the truck. Deborah filed suit in Marshall County on behalf of herself and in her capacity as the personal representative and administrator of the estate of her husband against Road Gear and fictitiously named defendants. Dement alleged that her injuries and the death of her husband were caused by Road Gear's negligence and wantonness and that Road Gear was liable under the Alabama Extended Manufacturer's Liability Doctrine ("the AEMLD"). Dement alleged in her complaint that venue was proper in Marshall County because she resided in Marshall County and Road Gear "does business in Marshall County." The Alabama Supreme Court determined FleetPride was Road Gear's "agent" in Marshall County for purposes of determining venue, and that Road Gear failed to show that it did not regularly do business in Marshall County at the time the suit was filed. First Student, Inc. v. Dep’t of Revenue
First Student, Inc., a school bus contractor, sought to reverse a Court of Appeals decision to affirm dismissal of its business and occupation ("B&O") tax refund action. At issue was whether First Student's transporting of students qualified as transporting persons "for hire" such that it made First Student subject to the public utility tax ("PUT") rather than the general B&O tax. The Washington Supreme Court found the meaning of "for hire" was ambiguous as used in the PUT, but resolved the ambiguity in favor of the long-standing interpretation that school buses were excluded from the definitions of "motor transportation business" and "urban transportation business" under RCW 82.16.010(6) and (12). The Court found that WAC 458-20-180 was a valid interpretation of the statute, and affirmed the Court of Appeals. View "First Student, Inc. v. Dep't of Revenue" on Justia Law
Dep’t of Transp. v. Mullen Trucking 2005, Ltd.
In May 2013, a clear and sunny day, William Scott, a driver for Mullen Trucking 2005 Ltd., was transporting an oversize load on Interstate 5 from Canada to Vancouver, Washington. Scott's truck had a pilot vehicle driven by Tammy Detray. Along the route was the Skagit River Bridge. As they entered and crossed the bridge in the right lane, Detray was distracted, talking to her husband on a handsfree cell phone device. Affixed to the right front of Detray's pickup was a 16-foot 2-inch tall clearance pole. Detray stated she did not strike the bridge with the pole, but this was contradicted by at least one witness who said the clearance pole hit the bridge four or five times. Detray was only 4.12 seconds and approximately 300 feet ahead of Scott. As Scott neared the bridge, he noticed a truck behind him quickly approaching. About a half mile before they entered the bridge, the approaching truck, owned by codefendant Motorways Transport Ltd. and driven by Amandeep Sidhu, was "virtually beside" Scott on his left, confining Scott to the right side of the bridge. Scott's oversize load struck the lower right curvature portion of 11 sway braces. By striking the trusses, Scott caused the north bridge section to collapse into the river. The State sued Mullen Trucking and Motorways Transport for negligence. The trucking companies counterclaimed, claiming the State was also negligent. The trucking companies conceded the State could not be held liable, but they sought to allocate fault to the State under Washington’s comparative fault statute to offset any damage award that may be entered against them. The Washington Supreme Court was asked to decide whether fault may be allocated to the State under the comparative fault statute when the maximum height statute stated "no liability may attach" to the State under these circumstances. Carroll Airport Commission v. Danner
The Supreme Court vacated the decision of the court of appeals declining to give preemptive effect to a no-hazard determination by the Federal Aviation Administration (FAA) and affirmed as modified the judgment of the district court, holding that the Federal Aviation Act allows for local zoning regulation, and the FAA's no-hazard letter did not preempt the local airport zoning regulations as a matter of law.A farmer built a twelve-story grain leg near an airport. The airport commission informed the farmer he needed a variance and refused to grant one. Thereafter, the FAA approved the structure. The local commissioners later brought this action in equity to force the farmer to modify or remove the structure. The district court issued an injunction. The court of appeals affirmed. The Supreme Court granted further review and held (1) state and local regulators can impose stricter height restrictions on structures in flight paths notwithstanding an FAA no-hazard determination, and therefore, the no-hazard letter did not preempt the local airport zoning regulations; and (2) the district court properly found that the structure constituted a threat to aviation requiring abatement, but the $200 daily penalty is vacated and the judgment is modified to require the farmer to abate the nuisance within nine months of this opinion. Skydive v. Horry
Skydive Myrtle Beach, Inc. brought this lawsuit alleging Horry County, the Horry County Department of Airports, and several of their individually named employees improperly attempted to remove Skydive from the space it leased at Grand Strand Airport in North Myrtle Beach, South Carolina. The circuit court dismissed Skydive's claims against the individually named employees pursuant to Rule 12(b)(6) of the South Carolina Rules of Civil Procedure, without allowing Skydive leave to amend its complaint. The court of appeals affirmed in an unpublished opinion. Finding that the circuit court should have allowed Skydive an opportunity to amend its complaint pursuant to Rule 15(a), the South Carolina Supreme Court reversed the court of appeals and remanded the case to the circuit court to allow Skydive an opportunity to file its amended complaint. Ziniti v. New England Central Railroad, Inc.
Plaintiff Matthew Ziniti sued defendant New England Central Railroad, Inc. after he was seriously injured in a train-car collision. Plaintiff appealed the trial court’s partial summary judgment ruling and the ensuing jury verdict for defendant, arguing the trial court erred by: (1) granting defendant summary judgment precluding him from presenting evidence that defendant’s failure to place a crossbuck on the right side of the road at the site of the railroad crossing, or to take steps to ensure that an “advance warning” sign was present, caused or contributed to the collision; (2) denying a request for the jurors to view the crossing where the accident occurred; (3) denying his motion for a directed verdict on the railroad’s negligence on account of its violation of a safety statute relating to maintenance of the railroad’s right of way; and (4) denying his request for an instruction on the sudden emergency doctrine. After reviewing the trial court record, the Vermont Supreme Court rejected each of these arguments and, accordingly, affirmed the judgment in favor of defendant. View "Ziniti v. Oregon Trucking Assns. v. Dept. of Transportation
The Oregon Department of Transportation (ODOT) owned driver records, which were considered as assets of the State Highway Fund and subject to use restrictions set out in Article IX, section 3a, of the Oregon Constitution. Pursuant to ORS 366.395, ODOT sold the Department of Administrative Services (DAS) an exclusive license to provide real-time electronic access to those driver records. Plaintiffs challenged both ODOT’s statutory authority to grant the license and the use to which DAS put it. The license permitted DAS to sublicense its rights and obligations to others; DAS sub-licensed its rights to NICUSA, the company that DAS enlisted to build the state internet portal. Through that portal, NICUSA provided electronic access to driver records and, pursuant to the sublicense agreement, charged a fee equal to what DAS paid for the license ($6.63 per record) plus an additional $3.00 per record convenience fee. The former amount/fee ultimately went to ODOT and into the highway fund to be used in accordance with Article IX, section 3a, and was predicted to produce $55 million dollars over the life of the license. The latter amount/fee was retained by NICUSA at least in part to recoup its costs in creating and maintaining the state internet portal. The end result was that disseminators pay $9.63 per record, $6.63 of which goes to ODOT and $3.00 of which NICUSA kept. Plaintiffs, which included nonprofit corporations representing their members’ interests, claimed the licensing agreements harmed them because, among other adverse effects, they had to pay disseminators an increased amount for driver records. Plaintiffs sought a declaration that ODOT did not have statutory authority to sell the license to DAS, and that the licensing agreements violated Article IX, section 3a. The Oregon Supreme Court determined ODOT lawfully transferred the license in question to DAS, and that neither the use to which DAS put the license, nor the value DAS paid for it it "ran afoul" of the Oregon Constitution. Schulenberg v. BNSF Railway Company
Terry Schulenberg, a train engineer for BNSF Railway Company, was injured when the train he was riding “bottomed out.” Schulenberg filed suit against BNSF, alleging liability for negligence under the Federal Employers’ Liability Act (FELA). BNSF filed motions to exclude Schulenberg’s expert witness and for summary judgment, both of which the district court granted. Schulenberg appealed, but the Tenth Circuit Court of Appeals concluded the district court did not abuse its discretion in excluding the expert witness because there was no discernable methodology offered for his opinions. And the Court concluded the district court was correct in granting summary judgment to BNSF because Schulenberg failed to present a dispute of material fact on his sole theory of liability on appeal, negligence per se. Straub v. BNSF
George Straub, an employee of BNSF Railway Company (“BNSF”), injured his back and neck when, in the course and scope of his duties, he attempted to adjust the engineer’s chair of Locomotive #6295. Straub brought suit, asserting BNSF was (among other things) strictly liable for his injuries under the provisions of the Federal Locomotive Inspection Act (“LIA”). BNSF moved to dismiss; the district court concluded Straub’s injuries did not implicate LIA. The district court ruled the adjustment mechanism of the engineer’s seat was not an “integral or essential part of a completed locomotive.” Instead, according to the district court, the seat adjustment mechanism was a non-essential comfort device. In reaching this conclusion, the district court relied on the Tenth Circuit’s decision in King v. Southern Pacific Transportation Co., 855 F.2d 1485 (10th Cir. 1988). Straub appealed, arguing the district court’s reliance on King was misplaced. The Tenth Circuit held that the allegations set out in Straub’s complaint (i.e., that the engineer’s chair failed when moved initially and stopped abruptly as Straub was attempting to adjust it) stated a violation of LIA: “Once BNSF installed an engineer’s chair with a seat adjustment mechanism, 49 U.S.C. 20701(1) mandated that BNSF maintain the chair so that the seat adjustment device be ‘in proper condition and safe to operate without unnecessary danger of personal injury’ and 49 C.F.R. 229.7 mandated that BNSF maintain the chair so that the seat adjustment mechanism was ‘in proper condition and safe to operate in service . . . without unnecessary peril to life or limb.’” The Court reversed the district court’s grant of BNSF’s motion to dismiss Straub’s claim to the extent it depended on LIA-based strict liability, and remanded this matter for further proceedings. Enable Oklahoma Intrastate v. 25 Foot Wide Easement
Plaintiff Enable Oklahoma Intrastate Transmission, LLC (“Enable”), appealed the district court’s dismissal of its case for lack of subject matter jurisdiction and for failure to join an indispensable party. Enable also challenged the amount of attorney fees the court awarded to the landowner defendants. Because the Tenth Circuit’s decision in Public Service Company of New Mexico v. Barboan, 857 F.3d 1101 (10th Cir. 2017), was dispositive of the subject matter jurisdiction issue, the Court affirmed the district court’s order dismissing the action.
