IAR Systems Software, Inc. v. Superior Court
IAR believed that defendant, its former CEO, had embezzled money. IAR, represented by Valla, sued defendant. Valla, on behalf of IAR, reported the crimes to the Foster City Police. The district attorney charged defendant with felony embezzlement. In response to defendant’s subpoena, Valla produced over 600 documents and moved to quash other requests on attorney-client privilege grounds. Defendant filed another subpoena, seeking documents relating to an email from the district attorney to Valla, discussing the need for a forensic accountant. Valla sought a protective order. Defendant asserted Valla was part of the prosecution team, subject to the Brady disclosure requirement. Valla and deputy district attorneys testified that Valla did not conduct legal research or investigate solely at the request of the police or district attorney, take action with respect to defendant other than as IAR's attorneys, nor ask for assistance in the civil matter. IAR retained a forensic accountant in the civil action, who also testified in the criminal matter, after being prepared by the district attorney. IAR paid the expert for both. There were other instances of cooperation, including exchanges of legal authority. The court found Valla to be a part of the prosecution team. The court of appeals reversed. The focus is on whether the third party has been acting under the government’s direction and control. Valla engaged in few, if any, activities that would render it part of the prosecution team. Lang v. Rogue Valley Medical Center
Pursuant to ORCP 54 B(1), the trial court dismissed plaintiff’s wrongful death action because it found that plaintiff’s counsel willfully failed to comply with two court orders and that, as a result, dismissal was an appropriate sanction. The Court of Appeals affirmed the resulting judgment without opinion. The Oregon Supreme Court allowed plaintiff’s petition for review to clarify the standard that applies when a trial court dismisses an action pursuant to ORCP 54 B(1) for failing to comply with a court order. The Court recognized the difficulty posed by counsel who, for one reason or another, seemed unable to move a case forward in a fair and efficient way. "We trust, however, that ordinarily courts will be able to take remedial steps and impose sanctions short of dismissal when faced with such problems." On this record, the Court could not say that the trial court’s dismissal was supported by evidence that plaintiff’s counsel willfully failed to comply with the court’s orders. Barlow v. Miss.State Bd. of Chiropractic Examiners
Dr. Andy Barlow was disciplined by the Mississippi State Board of Chiropractic Examiners for advertising in violation of the statutes governing chiropractors. The complaint alleged that Dr. Barlow advertised using professional designations other than “chiropractor,” “doctor of chiropractic,” “D.C.,” or “chiropractic physician”; Dr. Barlow advertised as D.C., and also as DACNB, FACFN, and as a “Chiropractic Neurologist.” The Board levied a monetary penalty plus the costs of his prosecution. The circuit court affirmed the Board, and Dr. Barlow appealed to the Mississippi Supreme Court, alleging that the statute governing chiropractic advertising had been implicitly amended or repealed, that the statute governing chiropractic advertising violated his First Amendment rights, and that the Board was without authority to assess the costs of the investigation to him. Furthermore, he argued the circuit court erred by failing to afford him a “de novo appeal.” Because Dr. Barlow’s arguments on whether he should be disciplined lack merit, the Court affirmed the judgments of the Board and circuit court on those issues. However, because the Board lacked authority to directly assess Dr. Barlow the costs of its investigation, the Court reversed on the issue of costs. View "Barlow v. Brandner v. Providence Health & Services
Providence Alaska Medical Center terminated Dr. Michael Brandner’s hospital privileges without an opportunity to be heard after determining he had violated hospital policy by failing to report an Alaska State Medical Board order requiring him to undergo an evaluation of his fitness to practice medicine. Brandner unsuccessfully challenged this action through the hospital's hearing and appeal procedures. Brandner thereafter took his cause to court, seeking reinstatement and damages for the alleged due process violations both in the procedures used and in the substantive standard applied in his termination. The superior court found no such violations and that he was not entitled to reinstatement. Brandner appealed. The Alaska Supreme Court affirmed in part and reversed in part, finding that Brandner was not entitled to reinstatement or post-termination-hearing damages. However, the doctor's due process rights were violated when he was not given a hearing following termination of his hospital privileges. The matter was remanded for further proceedings. Pedernal Energy, LLC v. Bruington
Tex. Civ. Prac. Rem. Code 150.002 provides that if an expert affidavit in a lawsuit or arbitration for damages arising out of the provision of professional services by licensed or registered professionals is not filed in accordance with the statute, the trial court shall dismiss the claim, and the dismissal may be with prejudice. The Supreme Court held that the statute affords trial courts discretion to dismiss either with or without prejudice. In this case, the statute required dismissal of the amended petition against Defendant. The trial court dismissed the claims without prejudice, but the court of appeals dismissed them with prejudice because, while the amended petition was accompanied by an expert affidavit, an expert affidavit was not filed with the original petition. The Court held that the trial court did not abuse its discretion by dismissing the claims with prejudice, as the record did not conclusively demonstrate that Plaintiff’s claims lacked merit or that the trial court’s decision violated any guiding rules and principles and therefore was an abuse of discretion. McDermott Will & Emery v. Super. Ct.
In this original proceeding, the issues presented for the Court of Appeal’s review related to a confidential attorney-client communication. The trial court found that plaintiff and real party in interest Richard Hausman, Sr. (Dick), did not waive the attorney-client privilege by forwarding a confidential e-mail he received from his personal attorney to his sister-in-law because Dick inadvertently and unknowingly forwarded the e-mail from his iPhone, and therefore lacked the necessary intent to waive the privilege. The trial court also impliedly found that Dick’s sister-in-law did not waive the privilege when she forwarded the e-mail to her husband, who then shared it with four other individuals, because neither Dick’s sister-in-law nor his brother-in-law could waive Dick’s attorney-client privilege, and Dick did not consent to these additional disclosures because he did not know about either his initial disclosure or these additional disclosures until a year after they occurred. In a separate order, the trial court disqualified Gibson, Dunn & Crutcher LLP (Gibson Dunn) from representing defendants-petitioners McDermott Will & Emery LLP and Jonathan Lurie (collectively, Defendants) in the underlying lawsuits because Gibson Dunn failed to recognize the potentially privileged nature of the e-mail after receiving a copy from Lurie, and then analyzed and used the e-mail despite Dick’s objection that the e-mail was an inadvertently disclosed privileged document. The Court of Appeal denied the petition in its entirety. Substantial evidence supported the trial court’s orders and the court did not abuse its discretion in selecting disqualification as the appropriate remedy to address Gibson Dunn’s involvement in this matter. “[R]egardless of how the attorney obtained the documents, whenever a reasonably competent attorney would conclude the documents obviously or clearly appear to be privileged and it is reasonably apparent they were inadvertently disclosed, the State Fund rule requires the attorney to review the documents no more than necessary to determine whether they are privileged, notify the privilege holder the attorney has documents that appear to be privileged, and refrain from using the documents until the parties or the court resolves any dispute about their privileged nature. The receiving attorney’s reasonable belief the privilege holder waived the privilege or an exception to the privilege applies does not vitiate the attorney’s State Fund duties.” View "McDermott Will & Emery v. Segura v. State
Plaintiffs’ attorney filed two board claim forms with a state appeals board on behalf of Plaintiffs, signing their names and his own. The attorney did not attach any document showing he had power of attorney. The board rejected Plaintiffs’ claims. Plaintiffs then filed their claim in district court. The district court dismissed Plaintiffs’ claims on the ground that their attorney signed the forms on their behalf. The Supreme Court reversed, holding (1) a claimant presents a claim when the board receives a writing that discloses the amount of damages claimed and generally describes the legal theories asserted against the State; and (2) the district court had jurisdiction to hear Plaintiffs’ claims. Goldstein, Garber & Salama, LLC v. J.B.
Plaintiff-appellee J.B. was injured when certified registered nurse anesthetist (“CRNA”) Paul Serdula sexually assaulted her in a surgical suite in the dental practice of defendant-appellant Goldstein, Garber and Salama, LLC (GGS). Serdula was hired by GGS as an independent contractor through anesthesia staffing agency Certified Anesthesia Providers; in accordance with its standard practice, that agency conducted an independent credentialing process on Serdula prior to placing him in any medical or dental facilities. The Georgia Supreme Court granted certiorari to the Court of Appeals to determine whether the Court of Appeals erred in concluding that a reasonable jury could find that a third party’s sexual molestation of J.B. was an act foreseeable by GGS, whether the appellate court erred in affirming the trial court’s denial of GGS’s motion for a directed verdict on the issue of negligence per se, and whether GGS waived any objection to the jury verdict’s apportionment of fault. Bond v. McLaughlin
In 2008, Kimberly Bond sued her former attorney, James McLaughlin, alleging legal malpractice. The trial court entered a summary judgment in favor of McLaughlin. In February 2006, Bond hired McLaughlin to provide legal services involving the estate of her husband, Kenneth Pylant II, who was killed in a motorcycle accident in 2005. McLaughlin allegedly failed to properly contest a copy of Pylant's will that was admitted to probate on November 29, 2005, and, as a proximate result of McLaughlin's breach of duty, Bond was injured and suffered damage. The Supreme Court found that Bond did not contest the will before probate, and, because of McLaughlin's negligence, she did not properly contest the will within six months after probate by filing a complaint with the circuit court. The Supreme Court determined that Bond presented evidence sufficient to overcome summary judgment, and accordingly reversed the circuit court’s order. The case was remanded for further proceedings. Bound Brook Bd. of Edu. v. Ciripompa
Defendant Glenn Ciripompa was a tenured high school math teacher in the Bound Brook School District. Defendant's behavior came under the scrutiny of the Bound Brook Board of Education (Board) after the Board received copies of student Twitter posts alleging "Mr. C" was electronically transmitting nude photographs. An investigation uncovered defendant's pervasive misuse of his District-issued laptop and iPad, as well as evidence of inappropriate behavior toward female colleagues, often in the presence of students. The results of the investigation spurred the Board to seek defendant's termination from his tenured position and served as the substantive allegations of the two-count tenure complaint against defendant. In this appeal, the issue presented for the Supreme Court's review centered on whether an arbitrator exceeded his authority by applying the standard for proving a hostile-work-environment, sexual-harassment claim in a law against discrimination (LAD) case to a claim of unbecoming conduct in the teacher disciplinary hearing. After review, the Supreme Court found that the arbitrator impermissibly converted the second charge of unbecoming conduct into one of sexual harassment. The arbitrator's review was not consonant with the matter submitted; rather, he imperfectly executed his powers as well as exceeded his authority by failing to decide whether Count II stated a successful claim of unbecoming conduct in support of termination.
