Johnson v. Idaho Dept of Labor
Dale Johnson maintained roller coasters for Silverwood, Inc. Among rising contentions and a dispute with Silverwood’s new director of construction and maintenance, Johnson resigned his position on June 8, 2015. He subsequently applied for unemployment benefits, but his claim was denied. Johnson challenged the denial with the Appeals Bureau of the Idaho Department of Labor, and a hearing was held on August 5, 2015. When denied again, Johnson appealed to the Industrial Commission. While the appeal was pending, Johnson learned that his hearing’s recording was lost. The Industrial Commission remanded the case to the Appeals Bureau for a new hearing. Ultimately, after two additional hearings and a second appeal to the Industrial Commission, Johnson won his claim for benefits with the Commission finding that Johnson was eligible for benefits. Johnson subsequently filed suit against the Department of Labor for unnecessary delays and other alleged improprieties in the handling of his claim. The district court dismissed the case for failure to file a notice of tort claim pursuant to the Idaho Tort Claims Act and then denied Johnson’s post-judgment motions. Finding no reversible error in the district court’s judgment, the Idaho Supreme Court affirmed the district court. View "Johnson v. Idaho Dept of Labor" on Justia Law
Ex parte D. P. T.
D.P.T. sought a writ of mandamus to direct the Circuit Court to rescind a discovery order that, D.P.T. asserted, required him to execute written authorizations allowing the respondents, D.P.T.'s insurers--United States Automobile Association, American Bankers Insurance of Florida, Inc., and American Collectors Insurance, LLC, to obtain records containing communications that he alleged were privileged under the psychotherapist-patient privilege. The insurers represented to the Alabama Supreme Court that they sought only D.P.T.'s "employment" records. In a rare move, the trial court itself filed a brief in response to the mandamus petition, in which it represented to the Supreme Court that it directed D.P.T. to execute an authorization allowing only the release of "employment" records. After review, the Supreme Court found D.P.T., who, as the petitioner, had the burden of establishing a clear legal right to the issuance of the writ of mandamus, did not demonstrate his "employment" records contained privileged communications. Ex parte CityR Eagle Landing, LLC
CityR Eagle Landing, LLC ("CityR"), and Foresite Realty Management, LLC ("Foresite"), petitioned the Alabama Supreme Court for a writ of mandamus to direct the Montgomery Circuit Court to vacate its order appointing Kia Scott as guardian ad litem for certain minor parties to the underlying action against CityR and Foresite. In 2016, residents of Eagle Landing Apartments, an apartment complex owned by CityR and managed by Foresite, sued CityR and Foresite, among others. They asserted claims of breach of contract, breach of implied warranty, negligence, wantonness, premises liability, negligent hiring, trespass, and nuisance, all arising out of conditions at the apartment complex. The residents were adults living in the apartments with their minor children, who were represented in the action by their parents. All the residents were represented by legal counsel. The Supreme Court determined the trial court exceeded its discretion in appointing a guardian ad litem to represent the minor residents when there was no conflict of interest between the minor residents and their parents. "At this point in the proceedings . . . the parents' interests are aligned with those of their children. . . . [W]ith nothing before us to reflect a conflict of interest between any parent and child involved as parties in the litigation, and no proposed settlement agreement currently before the trial court for review, there is no need for a guardian ad litem for the remaining minors at this stage of the proceedings." Accordingly, the Supreme Court granted the petition and issued the writ, directing the trial court to rescind its order of April 4, 2019, appointing the guardian ad litem to represent the remaining minor residents. Thompson v. Holliman
Maria Thompson filed sued Dennis Holliman and Allstate Property and Casualty Insurance Company (“Allstate”) alleging that Holliman had negligently operated his motor vehicle while pulling a trailer in a gas-station parking lot, resulting in a collision in which she was injured. A jury returned a verdict in favor of Holliman, and the circuit court entered a judgment consistent with the jury verdict. Aggrieved, Thompson appealed, alleging that the trial court had abused its discretion by excluding her expert witness. Finding no abuse of the trial court's discretion, the Mississippi Supreme Court affirmed judgment in Holliman's favor. View "Thompson v. Holliman" on Justia Law
Langley v. MP Spring Lake, LLC
In Langley v. MP Spring Lake, LLC, 813 SE2d 441 (2018), the Court of Appeals affirmed the trial court’s grant of summary judgment in favor of MP Spring Lake (“Spring Lake”) on two premises-liability tort claims brought by Pamela Langley. While a lawful tenant of Spring Lake Apartments in Morrow, Georgia, Langley fell in a common area of the complex when her foot got caught and slid on a crumbling portion of curb. She later made claims of negligence and negligence per se due to Spring Lake’s alleged failure to repair the curb despite being aware of its disrepair. Spring Lake asserted, as one of its defenses, that Langley’s claims were barred by a contractual limitation period contained within her lease. Spring Lake then moved for summary judgment on this basis, arguing that, because Langley’s lease contained a one-year limitation period for legal actions and she filed her complaint two years after the injury occurred, her claim was time-barred. Langley petitioned for certiorari, raising: (1) Does the “Limitations on Actions” provision of Langley’s lease contract apply to her premises-liability tort action against MP Spring Lake, LLC?; and (2) If so, is that provision enforceable? The Georgia Supreme Court concluded the provision was not applicable to Langley’s premises-liability tort action against Spring Lake. Rainey v. Taylor
Rapper Jayceon Taylor, also called “The Game,” starred in a VH1 television show called She’s Got Game. While filming in Chicago in 2015, Taylor took contestant Rainey on an off-camera date at a bar. Taylor sexually assaulted her by repeatedly lifting her skirt, grabbing her bare buttocks and vagina, and “juggling” her breasts in front of a large crowd as Rainey tried to break away. Rainey sued Taylor for sexual battery. Taylor evaded process, trolled Rainey on social media, dodged a settlement conference, and did not appear at trial. The judge denied his attorney's request for a continuance, dismissing Taylor’s proffered “dental emergency” excuse as an elaborate ruse. The judge instructed the jurors that they could infer from Taylor’s absence that his testimony would have been unfavorable to him. The jury awarded Rainey $1.13 million in compensatory damages and $6 million in punitive damages. The Seventh Circuit affirmed. District judges have wide discretion to manage their proceedings and resolve evidentiary issues. The rulings at issue lie well within that discretion. “Taylor has only himself to blame for the missing-witness instruction, which was plainly justified.” The verdict is well supported by the evidence; the compensatory award is not excessive under Illinois law, and the punitive award survives constitutional scrutiny. Weaver v. City of Everett
Michael Weaver, a former City of Everett firefighter, contracted melanoma. He filed a temporary disability claim, which the Washington Department of Labor & Industries (Department) denied, finding the melanoma was not work related. The melanoma spread to Weaver's brain, for which he filed a permanent disability claim. The Department denied it as precluded by the denial of the temporary disability claim. The issue his case presented for the Washington Supreme Court's review centered on whether the doctrines of collateral estoppel and res judicata properly precluded Weaver's permanent disability claim. The Court found collateral estoppel did not apply because the doctrine would work an injustice in this situation, given that Weaver did not have sufficient incentive to fully and vigorously litigate the temporary disability claim in light of the disparity of relief between the two claims. Likewise, the Court held that res judicata did not apply because the two claims did not share identical subject matter, given that the permanent disability claim did not exist at the time of the temporary disability claim. Bloom v. Casella Construction, Inc.
Plaintiff Eileen Bloom appealed a superior court order granting summary judgment to defendant Casella Construction, Inc. (Casella), ruling that the defendant did not owe the plaintiff a duty of care and was not otherwise liable to her pursuant to Section 324A of the Restatement (Second) of Torts. Plaintiff worked as a nurse at Dartmouth-Hitchcock Medical Center (DHMC). On December 30, 2013, she parked her car in an employee parking lot. She exited the vehicle, took two steps, and fell on a patch of ice. As a result of her fall, the plaintiff suffered injuries that required surgery. At the time of the plaintiff’s accident, DHMC had a “Snow Plowing Agreement” with Casella (the contract). “Snow Plowing Guidelines” (guidelines) were attached to the contract, calling for salting and sanding of DHMC grounds, and stating that “[e]mployee lots shall be kept plowed as clear as possible and accessible at the start of each shift change”; and “[g]enerally salt is applied to parking lots prior to or at the start of a storm and after storm cleanup or as directed by DHMC Grounds Supervisor or his designee.” Plaintiff alleged the contract obligated Casella to keep the employee parking lot in which she fell clear, and Casella breached that obligation. To the extent the trial court reasoned that there was no duty under the contract because Casella did not assume DHMC’s entire responsibility to keep its property free from unreasonable risks of harm, the New Hampshire Supreme Court disagreed. Whether DHMC directed Casella to apply sand and salt to the parking lot where plaintiff was injured raised a genuine issue of material fact which precluded the entry of summary judgment. For this reason, the Supreme Court reversed the grant of summary judgment and remanded for further proceedings. View "Bloom v. Casella Construction, Inc." on Justia Law
Short v. Versiga
Katherine Grace Short appeals the circuit court’s change of venue in her defamation case from the Circuit Court of the First Judicial District of Harrison County, Mississippi, to the Circuit Court of Jackson County, Mississippi. On the evening of August 1, 1975, Short’s husband, Tye Breland, died from a gunshot wound to the chest at their home in Pascagoula, in Jackson County, Mississippi. Short was not charged with Breland’s death. Forty-two years later, "Cold Justice: Beyond the Grave," a true-crime documentary (the episode), premiered on the Oxygen Network. The episode aired nationally, focused on Breland’s death, and considered whether Short murdered her late husband. During the episode, crime experts Kelly Siegler (identified as a prosecutor) and John Bonds (identified as a homicide investigator) investigated Breland’s death. Darren Versiga, a law-enforcement officer with the Pascagoula Police Department, assisted the investigation. The investigation team exhumed Breland’s body, prepared a mockup of the crime scene, conducted ballistics testing, and interviewed numerous witnesses to determine whether Breland’s death was a suicide, an accident, or a homicide. The team concluded that Breland did not commit suicide. They identified Short as a suspect in Breland’s death and turned over their investigation to the Jackson County District Attorney’s Office. According to the team, they put together enough information for a circumstantial case of murder. Short sued Siegler, Bonds and Versiga and various media entities, alleging defamation and tortious invasion of privacy. Versiga then filed a motion to transfer venue to the Circuit Court of Jackson County. In his motion, Versiga argued that the Circuit Court of Jackson County was the proper venue under Mississippi law because it was where a substantial alleged act or omission occurred or where a substantial event that caused the injury occurred. Versiga further argued that the Circuit Court of Jackson County was the proper venue “as it is the county in which [he] resides.” The Mississippi Supreme Court disagreed, determining the injury at issue occurred in Harrison county, and venue was proper there. Brock v. Price, et al.
Huey Brock appealed judgments dismissing his negligence action against Richard Price and KS Industries, LLC (“LLC”) and awarding Price and LLC costs and disbursements in the amount of $181,467. Price and LLC cross-appealed the judgment awarding costs and disbursements. In 2011, Brock was severely injured in a traffic accident while traveling in a company-owned vehicle with Price and another LLC employee, resulting in Brock becoming quadriplegic. Days later WSI accepted his claim for benefits. In June 2012, Brock, WSI, and LLC entered into a stipulation that Brock would continue to receive WSI benefits while seeking workers’ compensation benefits in California from KS Industries, LP (“LP”). The stipulation further provided that WSI would cease paying benefits if his claim against LP’s insurance carrier were accepted and his attorney would act in trust for WSI in pursuing reimbursement of funds paid in connection with Brock’s claim. Brock then filed an application for California workers’ compensation benefits claiming he was employed by LP at the time of the accident. Based on a California administrative decision, LP’s workers’ compensation carrier commenced paying benefits to Brock and reimbursed WSI all funds expended on Brock. In 2014, WSI issued a notice of decision reversing its prior decision accepting Brock’s claim. In February 2015, Brock brought this negligence action against Price and LLC. Brock moved for summary judgment arguing collateral estoppel based on the California administrative proceedings precluded Price and LLC from arguing LLC was Brock’s employer rather than LP, and therefore his action was not barred by the exclusive remedy provisions of North Dakota law. In November 2018, Price and LLC filed a motion for summary judgment arguing collateral estoppel did not apply and the exclusive remedy provisions applied to bar Brock’s action against LLC and his co-worker, Price. The district court agreed and dismissed the action. The North Dakota Supreme Court affirmed dismissal of the negligence action because it was indeed barred by the Workforce Safety and Insurance Act’s exclusive remedy provisions. The Court reversed the award of costs and disbursements and remanded for the court to hold a hearing on Brock’s objections required by N.D.R.Civ.P. 54(e)(2). View "Brock v.
