Dine Citizens Against Ruining Our Environment, et al. v. Haaland, et al.
Citizen groups challenged the Bureau of Land Management’s (“BLM”) environmental assessments (“EAs”) and environmental assessment addendum analyzing the environmental impact of 370 applications for permits to drill (“APDs”) for oil and gas in the Mancos Shale and Gallup Sandstone formations in the San Juan Basin of New Mexico. These challenges came after a separate but related case in which the Tenth Circuit Court of Appeals remanded to the district court with instructions to vacate five EAs analyzing the impacts of APDs in the area because BLM had failed to consider the cumulative environmental impacts as required by the National Environmental Policy Act (“NEPA”). BLM prepared an EA Addendum to remedy the defects in those five EAs, as well as potential defects in eighty-one other EAs that also supported approvals of APDs in the area. Citizen Groups argued these eighty-one EAs and the EA Addendum violated NEPA because BLM: (1) improperly predetermined the outcome of the EA Addendum; and (2) failed to take a hard look at the environmental impacts of the APD approvals related to greenhouse gas (“GHG”) emissions, water resources, and air quality. BLM disagreed, contending the challenges to some of the APDs were not justiciable because the APDs had not yet been approved. The district court affirmed the agency action, determining: (1) Citizen Groups’ claims based on APD’s that had not been approved were not ripe for judicial review; (2) BLM did not unlawfully predetermine the outcome of the EA Addendum; and (3) BLM took a hard look at the environmental impacts of the APD approvals. The Tenth Circuit agreed with BLM and the district court that the unapproved APDs were not ripe and accordingly, limited its review to the APDs that had been approved. Turning to Citizen Groups’ two primary arguments on the merits, the appellate court held: (1) BLM did not improperly predetermine the outcome of the EA Addendum, but, even considering that addendum; (2) BLM’s analysis was arbitrary and capricious because it failed to take a hard look at the environmental impacts from GHG emissions and hazardous air pollutant emissions. United States v. Dewayne Gray
Defendant appealed a judgment of the district court committing him to the custody of the Attorney General for medical care and treatment under 18 U.S.C. Section 4246. The court found that Defendant presently suffered from a mental disease or defect as a result of which his release from custody posed a substantial risk of bodily injury to another person or serious damage to the property of another.
The Eighth Circuit affirmed, concluding that the findings underlying the commitment were not clearly erroneous. The court explained that the district court’s finding that Defendant posed a substantial risk to persons or property was adequately supported in the record. The court relied on the unanimous recommendation of the experts. The experts observed that the most reliable predictor of future violence is past violence, and they detailed Defendant’s history of random and unpredictable violent actions. The court further found that the parties have not made a sufficient showing to justify sealing the briefs in this appeal. View "United States v. Dewayne Gray" on Justia Law
Troconis-Escovar v. United States
Suspecting that Troconis-Escovar was involved in the illegal drug business, the DEA searched his vehicle. Agents found $146,000 in cash, which they believed represented drug proceeds. DEA notified Troconis-Escovar that it intended to effect an administrative forfeiture of the funds (to declare them to be government property). Illegal drug proceeds are eligible for civil forfeiture under 21 U.S.C. 881(a)(6), subject to the procedural safeguards of the Civil Asset Forfeiture Reform Act, 18 U.S.C. 983. Troconis-Escovar’s attorney tried to contest the forfeiture, but filed the wrong form—a “petition for remission” rather than a “claim.” Only a claim may be used to challenge a proposed forfeiture. After the mistake was discovered, DEA gave Troconis-Escovar an extra 30 days to supplement his petition for remission. Troconis-Escovar did not do so and lost the money. He filed a Motion for the Return of Property under Federal Rule of Criminal Procedure 41(g).The district court dismissed his lawsuit, finding that it lacked jurisdiction. The Seventh Circuit affirmed. The dismissal was correct, but not because jurisdiction was lacking. Troconis-Escovar does not explain why he should be able to obtain relief outside section 983 when Congress expressly conditioned relief from civil forfeiture on circumstances that do not apply to him. Doe v. Scalia
Plaintiffs, employees at the Maid-Rite meatpacking plant, were exposed to COVID-19 in 2020. Maid-Rite issued masks and face shields but allegedly forced workers to work shoulder-to-shoulder. Plaintiffs sent OSHA an inspection request on May 19. Two days later, OSHA requested a response from Maid-Rite within a week, treating the inspection request as “non-formal,” so that it initially proceeded through document exchange. On May 27, Plaintiffs asserted that they continued to face an imminent danger of COVID-19; they also contacted OSHA on June 2, requesting Maid-Rite’s response and reasserting that conditions had not changed. They sent OSHA another letter on June 29th. On July 8, OSHA informed Maid-Rite that OSHA would inspect the plant the following day. OSHA acknowledged that advance notice of an inspection was not “typical,” but cited the need “to protect [OSHA’s] employees” from COVID-19. Plaintiffs claimed the notice allowed Maid-Rite to direct its employees to change their conduct and created the appearance of compliance with mitigation guidance. OSHA determined that the plant's conditions did not constitute an imminent danger and did not seek expedited relief.Plaintiffs sued under the Occupational Safety and Health Act, 29 U.S.C. 662(d), limited private right of action. While OSHA’s motion to dismiss was pending, OSHA concluded its standard enforcement proceedings and declined to issue a citation. The Third Circuit affirmed the dismissal of the complaint, holding that the Act mandated the dismissal of the claim once enforcement proceedings were complete. View "Doe v. Scalia" on Justia Law
Casson v. Orange County Employees Retirement System
Petitioner Nicholas Casson was a firefighter for the City of Santa Ana for 27 years. In 2012, he retired and began collecting a pension from California Public Employees Retirement System (CalPERS). He immediately started a second career with the Orange County Fire Authority (OCFA), where he was eligible for a pension under respondent Orange County Employees Retirement System (OCERS). He did not elect reciprocity between the two pensions, which would have allowed him to import his years of service under CalPERS to the OCERS pension. He started as a first-year firefighter for purposes of the OCERS pension and immediately began collecting pension payments from CalPERS. Five years into the job, he suffered an on-the-job injury that permanently disabled him. He applied for and received a disability pension from OCERS, which, normally, would have paid out 50 percent of his salary for the remainder of his life. However, because he was receiving a CalPERS retirement, OCERS imposed a “disability offset” pursuant to Government Code section 31838.5, the statute central to this appeal. This resulted in a monthly benefit reduction from $4,222.81 to $1,123.87. After exhausting his administrative remedies, Casson filed a petition for a writ of mandate; court denied the petition, finding that the plain language of section 31838.5 required a disability offset. The Court of Appeal reversed: Casson’s service retirement from CalPERS was not a disability allowance and thus should not have been included in the calculation of Casson’s total disability allowance. Crooks, et al. v. Louisiana, Dept. of Nat. Resources
This matter arose from a 2006 class action suit instituted by Steve Crooks and Era Lee Crooks (“Class Plaintiffs”) against the State through the Louisiana Department of Natural Resources (“LDNR”) concerning the ownership of riverbanks in the Catahoula Basin and subsequent mineral royalty payments. The Louisiana Supreme Court granted review in this case to address whether mandamus may lie to compel the State to pay a judgment rendered against it for mineral royalty payments. Finding that the payment of a judgment concerning the return of mineral royalties received by the State required legislative appropriation, an act that is discretionary in nature, the appellate court erred in issuing the writ of mandamus. Pineville City Court, et al. v. City of Pineville, et al.
The Pineville City Court was fully funded by the City of Pineville. This funding included amounts for the salaries of three clerk positions and accompanying human resources services. In turn, the City Court reimbursed the City for forty-percent of those expenses. In November 2020, the Pineville City Court informed the City that it would no longer reimburse the forty- percent as it had done in the past. Thereafter, the City sent notice that it would reduce payments of the clerks’ salaries by forty-percent, cease providing payroll and human resources services, pay only sixty-percent of the clerks’ retirement contributions, and discontinue the clerks’ participation in the city’s Blue Cross health plan. In this mandamus action the issue presented for the Louisiana Supreme Court's review was whether the court of appeal erred in reversing the trial court’s judgment that granted the City's exception of no cause of action. The plain language of La. R.S. 13:1888 A mandated only a minimum salary amount that must be paid to the city court clerk and deputy clerks. "The governing authorities have discretion to pay more than the mandated minimum salary. A mandamus action is an incorrect vehicle for the demand asserted by Pineville City Court because the underlying duty is not purely ministerial in nature." Bitner v. Dept. of Corrections & Rehabilitation
Plaintiffs-appellants Jennifer Bitner and Evelina Herrera were employed as licensed vocational nurses by defendant-respondent California Department of Corrections and Rehabilitation (CDCR). They filed a class action suit against CDCR alleging that: (1) while assigned to duties that included one-on-one suicide monitoring, they were subjected to acts of sexual harassment by prison inmates; and (2) CDCR failed to prevent or remedy the situation in violation of the California Fair Employment and Housing Act (FEHA), Government Code section 12940 et seq. The trial court granted summary judgment in favor of CDCR on the ground that it was entitled to statutory immunity under section 844.6, which generally provided that “a public entity is not liable for . . . [a]n injury proximately caused by any prisoner.” Plaintiffs appealed, arguing that, as a matter of first impression, the Court of Appeal should interpret section 844.6 to include an exception for claims brought pursuant to FEHA. Plaintiffs also argued that, even if claims under FEHA were not exempt from the immunity granted in section 844.6, the evidence presented on summary judgment did not establish that their injuries were “ ‘proximately caused’ ” by prisoners. Morris v. BB&T Corporation
The South Carolina workers' compensation commission dismissed an appeal to its appellate panel because the attorney filing the appeal missed a deadline for his brief. The commission refused to reinstate the appeal even after the attorney explained he made an innocent calendaring mistake, and then the commission refused to reconsider its decision. In all three instances, the commission gave no explanation of its decision; it simply issued a form order with blanks checked indicating the commission's action. The South Carolina Supreme Court found that because the commission offered no explanation for its decision, it did not act within its discretion in refusing to reinstate the appeal. "The failure to accurately calendar a filing deadline will not constitute good cause for reinstating an appeal in every instance. We have reviewed the record in this case, however, and we find Proffitt demonstrated good cause." The commission's decision refusing to reinstate the appeal was reversed and the case remanded to the appellate panel for consideration of the appeal on the merits. View "Morris v. Jane Doe v. United States
Plaintiff sued the government pursuant to the Federal Tort Claims Act (FTCA), asserting multiple negligent and intentional tort causes of action after being sexually assaulted by an employee of the United States Department of Veterans Affairs (VA). The government moved to dismiss for lack of subject matter jurisdiction. The district court granted the government’s motion. Plaintiff appealed the district court’s determination that the assault occurred outside the scope of the employee’s employment.
The Eighth Circuit affirmed. The court explained that the FTCA makes clear that the scope-of-employment test is defined by state law, not the employer. Plaintiff argued that the district court erred in concluding that the provider’s duties were restricted to providing battlefield acupuncture therapy (BFA). The court explained that initially, the provider denied sexually assaulting or massaging Plaintiff. He later admitted to the sexual assault and admitted that it was inappropriate for him to massage a patient. He also failed to document anything that occurred after the BFA therapy, including the massage. This is consistent with the finding that the massage and subsequent sexual assault exceeded the scope of his treatment authority. The court explained that in light of the pleadings and undisputed evidence, the district court did not err, determining that the provider acted outside the scope of his employment. View "Jane Doe v.
