Pacheco v. United States
Plaintiff Yesenia Pacheco sought contraception from Neighborcare Health, a federally funded community health center, “to prevent the birth of an unwanted child.” The method Pacheco and her care providers selected was Depo-Provera, “a highly effective” injectable contraceptive medication that “must be administered on a timely basis every eleven to thirteen weeks.” Pacheco received regular Depo-Provera injections from December 2009 until July 2011. On September 30, 2011 for her next scheduled appointment, a medical assistant “mistakenly injected [Pacheco] with a flu vaccine instead.” The medical assistant “failed to confirm why Ms. Pacheco was there, to document consent to the flu vaccine or a change in the orders, or to advise Ms. Pacheco of the side effects of a flu shot and/or the consequences of skipping a Depo-Provera injection.” Neighborcare did not inform Pacheco of its mistake until December 2011, when she sought an appointment for her next Depo-Provera injection. At that time, Neighborcare asked Pacheco to come to the clinic for a pregnancy test, which was positive. Plaintiff S.L.P. was born to Pacheco and plaintiff Luis Lemus, diagnosed with perisylvian polymicrogyria (PMG), a congenital defect resulting in permanent disabilities. In March 2017, Pacheco, Lemus, and S.L.P. filed an amended complaint against the United States pursuant to the Federal Tort Claims Act (FTCA) at the federal district court for the Western District of Washington, seeking damages relating to Pacheco’s pregnancy and S.L.P.’s PMG. The federal district court certified a question of law to the Washington Supreme Court, asking whether a patient who received negligent reproductive health care could recover all damages proximately caused by the provider’s negligence, regardless of the patient’s reason for seeking care. To this, the Supreme Court answered yes: if any Washington health care provider breaches their duty “to follow the accepted standard of care,” then damages proximately caused by the provider’s negligence may be recovered upon the necessary factual findings. Where negligent contraceptive care results in the birth of a child, and that child has a congenital defect, the provider may be liable for damages relating to the child’s condition. Such liability does not require proof that the child was at a known, heightened risk for developing congenital defects or that the patient sought contraception for the specific purpose of preventing the birth of a child with congenital defects. Estrada-Cardona v. Garland
In 2002, Petitioner Mayra Estrada-Cardona entered the United States on a tourist visa which she subsequently overstayed. She resided in the United States with her two United States citizen children: A.E. and L.E. A.E. suffers from mental and physical disabilities, some of which are likely to be lifelong. While in the United States, Petitioner played a key role in ensuring A.E. received physical therapy and special education support—both vital to A.E.’s wellbeing and continued progress. In 2009, Petitioner was arrested for driving without a license. She pled guilty and paid the associated fines, but because of the traffic violation, Immigration and Customs Enforcement detained Petitioner and began removal proceedings. At the hearing, Petitioner appeared unrepresented and conceded the charge contained in the notice to appear—rendering her removable. At the time, Petitioner was in the country for at most seven years, making her statutorily ineligible for any discretionary relief from removal. The immigration judge therefore ordered Petitioner to voluntarily depart the United States. Every year—from 2013 to 2017—Petitioner requested a stay of removal, and every year ICE approved her request. ICE denied her most recent request on December 28, 2017. ICE did not take any immediate action to remove Petitioner from the United States, only requiring her to attend regular check-ins at the local ICE office. ICE finally detained Petitioner and initiated removal on September 30, 2020. Petitioner asked the BIA to reopen removal proceedings pursuant to Pereira v. Sessions, 138 S. Ct. 2105 (2018). Petitioner's notice to appear failed to specify the “time and place at which the proceedings will be held.” Because the notice to appear did not stop the clock, Petitioner insisted that she had the requisite presence to be eligible for cancellation of removal because she had been in the country for 16 years. BIA held Petitioner was not eligible for cancellation of removal because the immigration judge issued the order to voluntarily depart, which qualified as a final order of removal, when Petitioner had accrued, at most, eight years of physical presence. The Tenth Circuit rejected the BIA's final-order argument, holding that a final order of removal did not stop the accrual of continuous physical presence. View "Estrada-Cardona v. Appeal of The Lawson Group, et al.
Petitioner The Lawson Group, the third-party administrator for the self-insured petitioner, Summit Packaging Systems (the employer), appealed a decision of the New Hampshire Compensation Appeals Board (CAB) that upheld a decision by respondent, the State Special Fund for Second Injuries (Second Injury Fund), to decline to reimburse The Lawson Group for benefits paid to the claimant. The employer hired the claimant in 2005 as a laborer and machine operator. The claimant was injured at work in January 2016, when she tried to catch a 65-pound spool of tubing as it fell. The claimant was out of work following the surgery, but returned in December 2016 in a modified duty capacity. In 2017, the CAB found that the claimant’s “surgery and subsequent treatment were and are related to the work injury” she suffered in January 2016. In August 2018, The Lawson Group applied to the Second Injury Fund for reimbursement. In a February 2019 letter, the Second Injury Fund denied The Lawson Group’s application because The Lawson Group had failed to: (1) establish that the claimant’s surgery constituted a subsequent disability by injury; and (2) demonstrate that the employer knew that the claimant had any permanent impairment before her surgery. Following a March 2020 hearing, the CAB upheld the Second Injury Fund’s denial of reimbursement. After a review of the CAB hearing record, the New Hampshire Supreme Court found no reversible error and affirmed the denial of reimbursement. View "Appeal of The Lawson Group, et al." on Justia Law
CV Amalgamated LLC v. City of Chula Vista
This litigation arose from a decision by the City of Chula Vista (the City) to reject applications by CV Amalgamated LLC, dba Caligrown (CVA) for licenses to operate retail cannabis stores in the City. In 2018, the City enacted an ordinance regulating commercial cannabis businesses (the Cannabis Ordinance). Among other things, the Cannabis Ordinance allowed for a maximum of eight storefront retail cannabis business licenses, with up to two licenses in each of the City’s four council districts (the Council Districts). CVA submitted applications for storefront retail cannabis business licenses in each of the City’s four Council Districts. CVA filed an appeal with the City Manager, in which it challenged the City’s rejections of its applications for licenses in Council Districts One, Three and Four. After a hearing, CVA's applications were again denied, and it initiated this litigation in September 2020. On January 29, 2021, the trial court issued an order denying CVA’s motion for a writ of mandate. The trial court made no factual findings and failed to explain why it concluded that CVA had failed to meet its burden. The Court of Appeal concluded the City failed to follow its ministerial and mandatory duty to follow its own procedures when it rejected CVA's applications in the initial assessments of the applications. The trial court's judgment was reversed with instructions to issue a writ of mandate directing the City to reassess CVA's applications in districts One, Three and Four. View "CV Amalgamated LLC v. Smith v. Becerra
When Plaintiff-appellant Linda Smith purchased a prescribed continuous blood glucose monitor (CGM) and its necessary supplies between 2016 and 2018, she sought reimbursement through Medicare Part B. Medicare administrators denied her claims. Relying on a 2017 ruling issued by the Centers for Medicare and Medicaid Services (CMS), Medicare concluded Smith’s CGM was not “primarily and customarily used to serve a medical purpose” and therefore was not covered by Part B. Smith appealed the denial of her reimbursement claims through the multistage Medicare claims review process. At each stage, her claims were denied. Smith then sued the Secretary of the Department of Health and Human Services in federal court, seeking monetary, injunctive, and declaratory relief. Contending that her CGM and supplies satisfied the requirements for Medicare coverage. Instead of asking the court to uphold the denial of Smith’s claims, the Secretary admitted that Smith’s claims should have been covered and that the agency erred by denying her claims. Rather than accept the Secretary’s admission, Smith argued that the Secretary only admitted error to avoid judicial review of the legality of the 2017 ruling. During Smith’s litigation, CMS changed its Medicare coverage policy for CGMs. Prompted by several adverse district court rulings, CMS promulgated a formal rule in December 2021 classifying CGMs as durable medical equipment covered by Part B. But the rule applied only to claims for equipment received after February 28, 2022, so pending claims for equipment received prior to that date were not covered by the new rule. Considering the new rule and the Secretary’s confession of error, the district court in January 2022 remanded the case to the Secretary with instructions to pay Smith’s claims. The district court did not rule on Smith’s pending motions regarding her equitable relief claims; instead, the court denied them as moot. Smith appealed, arguing her equitable claims were justiciable because the 2017 ruling had not been fully rescinded. The Tenth Circuit agreed with the Secretary that Smith’s claims were moot: taken together, the December 2021 final rule and the 2022 CMS ruling that pending and future claims for CGMs would be covered by Medicare deprived the Tenth Circuit jurisdiction for further review. Cook Inlet Fisherman’s Fund v. Alaska Dept. of Fish & Game, et al.
A nonprofit entity representing commercial fishers sued the Alaska Board of Fisheries and the Department of Fish and Game, alleging that the State’s fishery management practices in Cook Inlet were unjustified and violated federal law and national standards. The nonprofit sought to depose two current Fish and Game employees but the State opposed, arguing that all material facts necessary for a decision of the case were in the administrative record. The superior court agreed with the State and quashed the nonprofit’s deposition notices. The court also granted summary judgment in favor of the State, deciding that the Cook Inlet fishery was not governed by federal standards and that none of the nonprofit’s disagreements with the State’s fishery management practices stated a violation of statute or regulation. The nonprofit appealed. Finding no reversible error, the Alaska Supreme Court affirmed the superior court judgment. View "Cook Inlet Fisherman’s Fund v. In re Dependency of L.C.S.
A child was taken from his mother after she brought him to the hospital. Hospital staff found the child had serious injuries. The father, who lived separately from the mother, asked that the child be placed with him. The Washington State Department of Children, Youth and Family recommended out-of-home placement, citing concern for the child’s safety. A court determined the child should have been placed with his godparents, based on the Department’s recommendation. The father moved for discretionary review of the shelter care order, arguing the court erred because the Department failed to make reasonable efforts to prevent removal from a parent. The Court of Appeals denied review, and a panel of the court declined to modify its ruling. The father than moved for discretionary review by the Oregon Supreme Court, which was granted. The issue this case presented for the Supreme Court became moot, as the father ultimately agreed to an order of dependency in a subsequent hearing. The Supreme Court still opined on what “reasonable efforts” the Department had to make before a child could be removed for a parent or guardian’s care. The Department argued (and the trial court agreed) that given the acute and emergent circumstances of the case, it did not violate the reasonable efforts requirement. The father argued there was no such exception for emergent circumstances. The Supreme Court provided additional guidance as to what constituted reasonable efforts, and here, held the trial court erred in excusing the Department from making reasonable efforts to place the child with the father. Christine Levinson et al. v. Kuwait Finance House (Malaysia) Berhad
Appellees hold a Foreign Sovereign Immunities Act of 1976 (FSIA) judgment against the Islamic Republic of Iran. Based on that judgment, Appellees moved for a writ of execution against the assets of Kuwait Finance House (KFH) Malaysia in district court. The district court granted the writ before making any findings as to whether KFH Malaysia is an “agency or instrumentality” of Iran or whether the assets at issue are “blocked.” The primary issue on appeal is whether the Terrorism Risk Insurance Act of 2002 (TRIA) permits those assets to be executed prior to such findings.
The Second Circuit denied Appellees’ motion to dismiss the appeal, denied KFH Malaysia’s petition for a writ of mandamus, vacated the order granting the writ of execution, and remanded to the district court for further proceedings. The court explained to be entitled to attachment or execution under the TRIA a plaintiff must first establish defendant’s status as an agency or instrumentality. Here, these procedures were not followed. Article 52 permits parties to commence turnover proceedings to enforce money judgments. Below, that turnover proceeding commenced, but the district court granted the relief sought in that proceeding—a writ of execution—before it considered the antecedent issue of whether KFH Malaysia is an agency or instrumentality of Iran or whether the assets at issue are “blocked.” Without such findings, there has been no showing that KFH Malaysia is in possession of property. Accordingly, Appellees failed to meet the statutory and, and consequently, they failed to establish that they were entitled to a writ of execution. View "Christine Levinson et al. v. City of Ririe v. Gilgen
The Jefferson County, Idaho Board of Commissioners (“the County”) granted Appellant Tina Gilgen a conditional use permit that allowed her to place a mobile home on real property she owned with her husband, Kelly Gilgen. The Gilgen property fell within the City of Ririe’s area of impact (“AOI”). The City of Ririe (“the City”) petitioned for judicial review, claiming the County erroneously approved Gilgen’s application by applying Jefferson County zoning ordinances within the AOI instead of City ordinances, which would have resulted in a denial of Gilgen’s application. The City relied on an area of impact agreement between Jefferson County and the City of Ririe, in which the County specifically agreed to apply the City’s ordinances to property located within the AOI (“AOI Agreement”). After the County filed a notice of non-objection, the district court entered an order granting the City’s petition, reversing the County’s original decision, and remanding the matter to the County. On remand, the County issued an amended decision that denied Gilgen’s application for a conditional use permit. Several months later, Gilgen filed three motions for reconsideration of the district court’s order remanding the case, alleging the district court did not have jurisdiction to consider the City’s petition. Each of the motions was denied. The Idaho Supreme Court determined the City did not have standing to petition the district court for review of the County’s decision. Damien Guedes v. ATF
The Bureau of Alcohol, Tobacco, Firearms, and Explosives (“ATF” or the “Bureau”) promulgated a rule classifying “bump stocks” as machine guns. The Bureau’s new rule instructed individuals with bump stocks to either destroy them, abandon them at the nearest ATF facility, or face criminal penalties. Plaintiffs initially moved for a preliminary injunction to stop the rule from taking effect, which the District Court denied, and a panel of this Court affirmed. At the merits stage, the District Court again rejected Plaintiffs’ challenges to the rule under the Chevron framework. See Chevron, U.S.A., Inc. v. Natural Resources Defense Council, Inc., 467 U.S. 837 (1984).The central question on appeal was whether the Bureau had the statutory authority to interpret “machine gun” to include bump stocks and the DC Circuit affirmed. In employing the traditional tools of statutory interpretation, the court found that the disputed rule is consistent with the best interpretation of “machine gun” under the governing statutes. The court explained that it joins other circuits in concluding that these devices, which enable such prodigious rapid-fire capability upon a pull of the trigger, fall within the definition of “machine gun” in the National Firearms Act and Gun Control Act.
