DAVID DONOVAN, ET AL V. BRIAN VANCE
Plaintiffs, a group of Federal contractor employees and Federal employees working for the Department of Energy, challenged two Executive Orders, Executive Orders 14,042 and 14,043 (EOs), issued in September 2021. 1 Those EOs mandated COVID-19 vaccination for Federal contractor employees and Federal employees, respectively. They also provided for legally required medical or religious exemptions. Plaintiffs challenged the EOs as ultra vires exercises of presidential power in violation of the Federal Property and Administrative Services Act (Procurement Act), the Office of Federal Procurement Policy Act (Procurement Policy Act), the Administrative Procedure Act (APA), the Religious Freedom and Restoration Act (RFRA), the major questions doctrine, and general constitutional federalism constraints. Plaintiffs sought injunctive and declaratory relief to address their allegedly “imminent and wrongful terminations” for failure to comply with the vaccination requirements. The district court held that Plaintiffs who had submitted religious and medical exemptions but who had not yet completed the exemption request process did not have claims ripe for adjudication. The district court then dismissed the operative Second Amended Complaint with prejudice for failure to state a claim and without leave to amend.
The Ninth Circuit affirmed in part and dismissed as moot in part. The panel concluded that the case was moot as to all non-RFRA claims. The vaccine mandate exemption processes that the Plaintiffs challenged were premised on the revoked EOs. The panel held that it could not provide relief from EOs and exemption processes that no longer exist. Accordingly, no live controversy remained between the parties. USA V. PETROSAUDI OIL SERV. (VENEZUELA) LTD., ET AL
The United States (“the Government”) initiated a civil forfeiture suit in federal district court against a $380 million arbitration award fund, the majority of which is held in the United Kingdom. The fund belongs to PetroSaudi Oil Services (Venezuela) Ltd. (“PetroSaudi”), a private oil company incorporated in Barbados. PetroSaudi won the award in an arbitration proceeding against Petróleos de Venezuela, S.A. (“PDVSA”), a Venezuelan state energy company. The portion of the fund held in the United Kingdom (“the fund”) is held in an account controlled by the High Court of England and Wales (“the High Court”). The Government seeks forfeiture of the fund on the ground that it derives from proceeds of an illegal scheme to steal one billion dollars from the Malaysian sovereign wealth fund 1Malaysia Development Berhad (“1MDB”). PetroSaudi challenged two orders entered by the district court.
The Ninth Circuit affirmed the district court’s interlocutory orders. The panel held that PetroSaudi’s appeal from the district court’s protective order under 18 U.S.C. Section 983 fell within this exception. Accordingly, the court had jurisdiction to consider the appeals of the two orders. The panel concluded that the sovereign immunity of the United Kingdom, as codified in the FSIA, did not protect the arbitration award fund from the two orders issued by the district court. The panel held that because the district court had in rem jurisdiction over the fund, it did not need in personam jurisdiction over PetroSaudi to issue an order preserving the fund. View "USA V. TOCH, LLC v. City of Tulsa, et al.
TOCH, LLC, the owner and operator of Aloft Hotel, alleged that the Tulsa Tourism Improvement District No. 1 was allegedly improperly created because fifty percent or more of the affected hotel owners protested in writing prior to its creation. City of Tulsa and Tulsa Hotel Partners sought summary judgment on this issue and disputed this material fact by submitting affidavits to disprove TOCH's allegation. The trial court granted summary judgment to the City, but the Oklahoma Supreme Court found the trial court erred when it made a factual determination on this controverted fact. Longmont United Hospital v. NLRB
Longmont United Hospital (Longmont) petitioned for a review of the decision of the National Labor Relations Board (NLRB or Board), concluding that Longmont violated the National Labor Relations Act by refusing to bargain with the National Nurses Organizing Committee/National Nurses United, AFL-CIO (Union). Longmont does not dispute that it refused to bargain with the Union. Instead, it challenges the representation election whereby a group of registered nurses at Longmont elected the Union as its exclusive collective bargaining representative.
The DC Circuit denied Petitioner's petition for review and granted the Board’s cross-application for enforcement. The court reasoned that Longmont has not shown a basis to disturb the Hearing Officer’s credibility findings. Further, the court held that the Board correctly declined to relitigate issues in the enforcement proceeding that had been decided in the representation proceeding. The Board did not adjudicate the General Counsel’s request for compensatory relief, and, as a result, any challenge to the fact or measure of compensatory damages is premature. Abbott v. Biden
Governor Abbott filed suit on January 4, 2022. He alleged that the military vaccine mandate is arbitrary and capricious within the meaning of the Administrative Procedure Act (“APA”). He also alleged that all but one of the Government’s planned enforcement measures violates the Constitution. For relief, Governor Abbott sought an order declaring the vaccination requirement and the challenged enforcement measures unlawful, Guardsmen. He also requested costs, attorneys’ fees, and any other relief the court deems proper. Governor Abbott then moved for an order preliminarily enjoining the defendants from enforcing the vaccine mandate against members of the Texas militia not in federal service. The district court denied the motion. The Governor appealed under 28 U.S.C. Section 1292(a)(1).
The Fifth Circuit vacated the district court’s order denying Governor Abbott’s motion for a preliminary injunction and remanded for further proceedings. The court explained that the Government conceded that its erstwhile vaccine mandate is unnecessary to military readiness by repealing it. The question, therefore, is whether the President can punish non-federalized Guardsmen in Texas who refused to get COVID injections before the President and Congress deemed such injections unnecessary. The court held that the Constitution’s text, history, and tradition foreclose the President’s efforts to impose such punishments. View "Abbott v. Biden" on Justia Law
Citizens for Constitutional Integrity, et al. v. United States, et al.
Plaintiffs Citizens for Constitutional Integrity and Southwest Advocates, Inc. appealed the denial of their motion for temporary relief by the United States District Court for the District of Colorado. The Department of the Interior’s Office of Surface Mining Reclamation and Enforcement (the Office) granted a coal-mining permit for an expansion of the King II Mine (the Mine) in the Dunn Ranch Area of La Plata County, Colorado. Plaintiffs sought to enjoin mining under the expansion and ultimately vacate the permit. They alleged the Office conducted flawed assessments of the probable hydrologic impacts of the expansion, contrary to the requirements of the Surface Mining Control and Reclamation Act (the SMCRA or the Act). As authority for their motion, they invoked the Act’s citizen-suit provision, or alternatively, the Administrative Procedure Act (the APA). The Tenth Circuit Court of Appeals concluded Plaintiffs were not entitled to temporary relief because their claims under the SMCRA and the APA were not likely to succeed on the merits. Barrosse v. Huntington Ingalls
Plaintiff worked for Defendant Huntington Ingalls (formerly “Avondale”) as a shipyard electrician from February 1969 to June 1977. In March 2020, Plaintiff was diagnosed with mesothelioma. Following his diagnosis, he filed a state-law tort suit in the Civil District Court for the Parish of Orleans, alleging that Avondale, among other defendants, caused Plaintiff to contract mesothelioma by exposing him to asbestos in a negligent manner. Because Plaintiff primarily worked on United States Navy ships when he was exposed, Avondale removed the case to the federal district court under the federal officer removal statute. Plaintiff never claimed benefits under the LHWCA, which provides a no-fault compensation remedy to injured workers. Avondale moved for summary judgment. The district court held that the claims are preempted.
The Fifth Circuit reversed and remanded. The court held express preemption does not apply. Despite the clear proclamation of exclusivity in the LHWCA’s text that prohibits any liability “at law or in admiralty” for injuries covered by the Act, there is no express preemption here. The court wrote that its conclusion that conflict preemption does not apply is supported by the existence of concurrent jurisdiction and the acceptable incongruity inherent therein, the Supreme Court’s consistent rejection of arguments resisting that regime, the LHWCA’s role of supplementing rather than supplanting state law, the limited category of claims at issue here, and the similarity between these claims and those the Supreme Court has already permitted in Hahn. Gene Schaerr v. DOJ
Plaintiff filed Freedom of Information Act (“FOIA”) requests with six intelligence agencies for any records about the unmasking of members of President Trump’s campaign and transition team. Plaintiff sought to uncover what he alleges was inappropriate intelligence surveillance for political purposes. Declining to produce any records, the Agencies issued so-called Glomar responses, explaining that even the existence or nonexistence of such records was exempted from FOIA. The district court granted summary judgment for the Agencies, concluding that FOIA exempted the information Plaintiff requested and that the Agencies had no obligation to search for responsive records before invoking Glomar.
The DC Circuit affirmed. The court explained that an agency properly issues a Glomar response when its affidavits plausibly describe the justifications for issuing such a response, and these justifications are not substantially called into question by contrary record evidence. Because the Glomar procedure protects information about even the existence of certain records, an agency need not search for responsive records before invoking it. Here, the Agencies have properly invoked Glomar on the grounds that the information Plaintiff seeks is protected by FOIA Exemptions One and Three, and nothing in the record suggests the Agencies acted in bad faith in issuing their responses. Livingood v. City of Des Moines
The Supreme Court affirmed in part and reversed in part the judgment of the district court denying three plaintiffs' motion for summary judgment in this suit brought to challenge the City of Des Moines' use of the state's income offset program to collect automated traffic citation penalties and granting summary judgment in favor of the City, holding that the district court erred in granting summary judgment as to a preemption claim and a claim for unjust enrichment.Specifically, the Supreme Court held that the district court properly dismissed Plaintiffs' claims that, among other things, the City's use of the income offset program amounted to an unconstitutional taking and that their right to procedural due process was violated. As to Plaintiffs' contention that the City's use of the program was preempted by state law, however, the district court reversed in part, holding that the district court erred in dismissing one plaintiff's preemption claim with respect to his requests for declaratory and injunctive relief and in dismissing two plaintiffs' claim for unjust enrichment. Dickenson v. Benewah County
Rodney Dickenson brought a whistleblower case against the Benewah County Sheriff’s Office (“BCSO”), Benewah County Board of Commissioners, and former Benewah County Sheriff, David Resser (collectively, the “County”). BCSO told Dickenson that his employment was being terminated for violating law enforcement policy and ethics. Dickenson alleged his termination violated Idaho’s Whistleblower Act because he was terminated for secretly recording meetings with Sheriff Resser and Undersheriff Anthony Eells to document malfeasance and the illegal activities of some deputies. After unsuccessful attempts at administrative appeals, Dickenson filed a complaint in district court alleging wrongful termination from his employment as a sergeant, in violation of Idaho Code sections 6-2101-2109, “because he communicated in good faith, with reasonable basis in fact, regarding a violation or suspected violation of the law.” The County moved for summary judgment on Dickenson’s complaint, which the district court granted, concluding Dickenson could not show he was fired for engaging in a protected activity. Dickenson appealed, arguing: (1) disputed issues of material fact precluded summary judgment; (2) the question of causation should have been a question for the jury; and (3) that the district court erred in its interpretation of the Whistleblower Act. The Idaho Supreme Court found that while these three issues were clear from Dickenson's opening brief, the brief included practically no citations to the record to support his claims. Neither the recordings themselves nor a transcript of either meeting was in the record, and the Court was left to divine from Dickenson’s generalized or conclusory statements in his affidavit what was said. "This dilemma alone is not just problematic, but fatal to Dickenson’s position on appeal." The district court concluded that Dickenson did not “provide[] evidence creating a genuine issue of material fact that he was terminated because he engaged in an activity protected by Idaho’s Whistleblower Act, and summary judgment [is] granted to defendants.” The Supreme Court affirmed the district court’s decision.
