According to the allegations of the complaint, the plaintiffs were adult and minor Argentinean citizens. The defendants, Philip Morris USA Inc. (“PM USA”) and Philip Morris Global Brands, Inc. (“PM Global”), owned Massalin Particulares, S.A., a tobacco production company. In 1984, Massalin created a brokerage company, Tabacos Nortes, to purchase tobacco from small, family-owned farms in Misiones, Argentina. The plaintiffs owned and live on these farms, raising livestock and growing produce for their own consumption adjacent to the tobacco plants. Tabacos Nortes required the farmers to purchase and use herbicides and pesticides, which it sold to the farmers on credit. Monsanto Company developed, marketed, and supplied the herbicide “Roundup,” which, according to the complaint, contained chemical ingredients and toxins capable of causing “genetic, teratogenic, and/or developmental injury to humans.” The plaintiffs mixed chemicals like Roundup and sprayed the tobacco crops by hand with chemicals from containers on their backs. As alleged in the complaint, the defendants knew that the plaintiffs’ personal crops, livestock, and water would be contaminated with the herbicides and pesticides. The plaintiffs further alleged the defendants never recommended protective measures, but knew the plaintiffs lacked protective equipment and the knowledge required for safe use of the chemicals. In consolidated appeals the issue before the Delaware Supreme Court was whether a trial court must first determine that an available alternative forum existed before dismissing a case for forum non conveniens. The Supreme Court held that an available alternative forum should be considered as part of the forum non conveniens analysis, but was not a threshold requirement. Because the Superior Court considered the availability of an alternative forum as a factor in its forum non conveniens analysis, its judgment was affirmed. View "Aranda, et al. v. This appeal arose out of a private enforcement action under Section 505 of the Clean Water Act (CWA), 33 U.S.C. 1365. Defendant-Appellant Ozark Materials River Rock, LLC, appealed a district court’s order approving Plaintiff-Appellee David Benham’s proposed restoration plan of unlawfully filled wetlands in Saline Creek. Ozark was a sand and gravel mining company that operated on property adjacent to Saline Creek in Oklahoma. Benham recreates in Saline Creek and claimed Ozark’s operations degraded his ability to do so. In March 2011, Benham served Ozark with a notice letter pursuant to Section 505, informing the company that it was violating Section 404 of the CWA, 33 U.S.C. 1344. Section 404 required a permit from the Army Corps of Engineers to discharge dredge or fill material into navigable waters if the activity disturbed more than one-half acre of wetland, and Ozark did not have a Section 404 permit. The Army Corps of Engineers had inspected Ozark’s operations in 2010 (again in 2012 and 2013) by driving through the property, but it found no CWA violations. Nevertheless, after receiving Benham’s notice, Ozark hired an environmental consulting firm to perform a Section 404 impact analysis of Ozark’s Saline Creek operations. By June 1, 2011, Ozark had not addressed the CWA violations that Benham alleged in his notice, so he filed the underlying citizen suit, as authorized by Section 505. The district court held a bench trial and found that Ozark’s construction of a roadway in Saline Creek and the filling of its surrounding wetlands without a permit constitute a continuing violation of the CWA. The district court imposed a civil penalty of $35,000 and ordered briefing on a restoration plan for the unlawfully filled wetlands. On June 1, 2017, the district court issued an order adopting (substantially all of) Benham’s proposed restoration plan; one element of the plan created a conservation easement for the restoration site. Ozark raised several issues on appeal challenging the district court’s order and underlying findings of fact and conclusions of law. The Ninth Circuit denied without prejudice a petition for a writ of mandamus where federal defendants sought an order directing the district court to dismiss a case seeking various environmental remedies. Plaintiffs, twenty-one young individuals, filed suit alleging defendants have contributed to climate change in violation of plaintiffs' constitutional rights. Defendants argued that allowing the case to proceed would result in burdensome discovery obligations on the federal government that would threaten the separation of powers. The panel held that defendants did not not satisfy the Bauman factors at this stage of the litigation, and the issues that defendants raised on mandamus were better addressed through the ordinary course of litigation. In this case, the district court had not issued a single discovery order, plaintiffs have not filed a single motion seeking to compel discovery, any merits errors were correctable through the ordinary course of litigation, and there was no controlling Ninth Circuit authority on any of the theories asserted by plaintiff. In 2003, the Legislature enacted Water Code section 1525, which required the holders of permits and licenses to appropriate water to pay an annual fee according to a fee schedule established by the Board. At the same time, the Legislature enacted sections 1540 and 1560, which allowed the Board to allocate the annual fee imposed on a permit or license holder who refuses to pay the fee on sovereign immunity grounds to persons or entities who contracted for the delivery of water from that permit or license holder. Plaintiffs Northern California Water Association, California Farm Bureau Federation, and individual fee payors claimed that the annual fee imposed in fiscal year 2003-2004 constituted an unlawful tax, as opposed to a valid regulatory fee because it required fee payors to pay more than a de minimis amount for regulatory activities that benefited nonfee-paying right holders. Plaintiffs also claimed that the fees allocated to the water supply contractors violated the supremacy clause of the United States Constitution because they exceeded the contractors’ beneficial interests in the USBR’s water rights. The California Supreme Court previously ruled sections 1525, 1540, and 1560 were constitutional on their face. The Supreme Court found that the record was unclear as to: (1) “whether the fees were reasonably apportioned in terms of the regulatory activity’s costs and the fees assessed;” and (2) “the extent and value of the [contractors’ beneficial] interests.” Accordingly, the Supreme Court directed the Court of Appeal to remand the matter to the trial court to make findings on those issues. Following a 10-day bench trial, the trial court issued a statement of decision that determined inter alia that the statutory scheme as applied through its implementing regulations imposed a tax, as opposed to a valid regulatory fee, by allocating the entire cost of the Division’s regulatory activities to permit and license holders, while nonpaying-water-right holders who benefit from and place burdens on the Division’s activities pay nothing. The trial court likewise found that the fees passed through to the water supply contractors in fiscal year 2003-2004 pursuant to regulation 1073 ran afoul of the supremacy clause “because the allocation of fees [was] not limited to the contractors’ beneficial or possessory use of the [USBR’s] water rights.” In addition, the trial court found that the fee regulations were invalid because they operated in an arbitrary manner as to a single payor, Imperial Irrigation District. Accordingly, the trial court invalidated regulations 1066 and 1073, “as adopted by Resolution 2003-0077 in 2003-2004.” The Board appealed, contending the trial court erred in invalidating the fee regulations. The Court of Appeal concluded the trial court’s central premise was wholly incorrect because it failed to recognize the role that general fund money played in fiscal year 2003-2004: the fees assessed on permit and license holders were proportionate to the benefits derived by them or the burdens they placed on the Division. The trial court erred in determining that the fee regulations were invalid based on their application to a single payor. Accordingly, the Court reversed the judgment invalidating the fee regulations. The Clean Water Act, 33 U.S.C. 1362, prohibits “any addition of any pollutant to navigable waters,” defined as “the waters of the United States.” Section 1311(a) contains exceptions, including permitting schemes under the EPA's National Pollutant Discharge Elimination System (NPDES) program and an Army Corps of Engineers program, which encompass the “waters of the United States.” The EPA and the Corps proffered the “Waters of the United States (WOTUS) Rule,” which “imposes no enforceable duty on any state, local, or tribal governments, or the private sector,” 80 Fed. Reg. 37102 and “does not establish any regulatory requirements.” Objectors challenged the Rule in district courts. Many filed “protective” petitions in Circuit Courts to preserve their challenges should their district court lawsuits be dismissed for lack of jurisdiction under 33 U.S.C. 1369(b), which enumerates EPA actions for which review lies directly and exclusively in the federal courts of appeals. Such actions include EPA actions “approving or promulgating any effluent limitation or other limitation under section 1311, 1312, 1316, or 1345,” and EPA actions “issuing or denying any permit under section 1342.” The Sixth Circuit denied motions to dismiss consolidated actions. The Supreme Court reversed. The Rule falls outside section 1369(b)(1), so challenges must be filed in district courts. It is not an “effluent limitation,” “on quantities, rates, and concentrations” of pollutants, nor is it an “other limitation under section 1311; it simply announces a regulatory definition. The Rule was promulgated under section 1361(a), which grants the EPA general rulemaking authority. The Rule neither issues nor denies NPDES permits under section 1342. Plaintiffs Clews Land and Livestock, LLC; Barbara Clews; and Christian Clews (collectively, CLL) appealed a judgment in favor of defendant City of San Diego (City) on CLL's petition for writ of mandate and complaint for declaratory and injunctive relief, violation of procedural due process, and equitable estoppel. CLL challenged the City's approval of a project to build a private secondary school on land neighboring CLL's commercial horse ranch and equestrian facility and the City's adoption of a mitigated negative declaration (MND) regarding the project. CLL contended the City should not have adopted the MND because the Cal Coast Academy project would cause significant environmental impacts in the areas of fire hazards, traffic and transportation, noise, recreation, and historical resources, and because the MND identified new impacts and mitigation measures that were not included in the draft MND. CLL further argued the City should not have approved the project because it is situated in designated open space under the applicable community land use plan and because the City did not follow the provisions of the San Diego Municipal Code (SDMC) applicable to historical resources. After review, the Court of Appeal concluded CLL's challenge to the MND was barred because it did not exhaust its administrative remedies in proceedings before the City. In doing so, the Court rejected CLL's argument that the City's process for administrative appeals (at least as implicated by this project) violated the California Environmental Quality Act by improperly splitting the adoption of an environmental document (e.g., the MND) from the project approvals. In addition, the City complied with all applicable requirements of the SDMC regarding historical resources and the City's approval of the project did not conflict with the open space designation because the project would be located on already-developed land. Respondents-petitioners Central Coast Forest Association and Big Creek Lumber Company asked the Fish and Game Commission to remove (delist) coho salmon south of San Francisco from the list of endangered species in California. Petitioners owned and harvested timber from lands in the area of the coho salmon spawning streams in the Santa Cruz Mountains. Timber harvesting is in part responsible for declining coho salmon populations. The petitioners argued: (1) there never were wild, native coho salmon in streams south of San Francisco, a requirement of being listed as endangered; (2) if there were, they were extirpated by environmental conditions unfavorable to the species; and (3) the salmon currently present in the streams are hatchery plants, implying that the fish are not members of the CCC ESU, and consequently are not deemed wild or native to California. They tender evidence in support of the petition, which they claim “may . . . warrant[]” delisting by the Commission. If sufficient scientific evidence contained in the petition, considered in the light of the department’s scientific report and the department’s expertise, would justify delisting of the species, then the Commission might consider delisting. The Court of Appeal concluded, however, that the evidence presented here did not meet that threshold. The Court concluded the petition did not contain sufficient scientific evidence, considered in light of the department’s scientific report and expertise, to justify delisting the coho salmon south of San Francisco; therefore, there was insufficient evidence that the delisting may be warranted.
