Cal Fire’s investigation of the 2007 Moonlight Fire determined that the fire started on property owned by landowner defendants and managed by Beaty. Sierra Pacific purchased the standing timber on the property, and contracted with Howell, a licensed timber operator, to cut the timber. On the day the Moonlight Fire began, two of Howell’s employees, Bush and Crismon, were working on the property installing water bars. Cal Fire’s investigators concluded the fire began when the bulldozer Crismon was operating struck a rock or rocks, causing superheated metal fragments from the bulldozer’s track to splinter off and eventually to ignite surrounding plant matter, and that the fire was permitted to spread when Bush and Crismon failed to timely complete a required inspection of the area where they had been working that day. On the eve of trial in July 2013, consolidated actions were dismissed following a hearing after the trial court concluded Cal Fire could not as a matter of law state a claim against Sierra Pacific, Beaty, or landowner defendants, and that no plaintiff had presented a prima facie case against any defendant. After judgment was entered, the trial court awarded defendants costs without apportionment amongst plaintiffs. It also ordered Cal Fire to pay to defendants attorney fees and expert fees totaling more than $28 million because defendants as prevailing parties were entitled to recover attorney fees on either a contractual basis or as private attorneys general, or alternatively as discovery sanctions. The trial court additionally imposed terminating sanctions against Cal Fire. Plaintiffs appealed, challenging both the judgment of dismissal (case No. C074879) and the postjudgment awards (case No. C076008). Plaintiffs also requested that any hearings on remand be conducted by a different judge. In the published portion of its opinion, the Court of Appeal concluded the trial court’s order dismissing the case as to all plaintiffs based on their failure to present a prima facie case at a pretrial hearing should have been reversed because the hearing was fundamentally unfair: Plaintiffs were not provided adequate notice of the issues on which they would be asked to present their prima facie case. However, the Court concluded the trial court did properly award judgment on the pleadings against Cal Fire. In light of these conclusions, in the unpublished portion of its opinion, the Court found the trial court’s award of costs to defendants as prevailing parties as to any plaintiff but Cal Fire was vacated, and because the trial court did not apportion costs, the costs award was remanded to determine which costs Sierra Pacific, Beaty, and landowner defendants could recover from Cal Fire. Furthermore, the Court determined the trial court erred in awarding attorney fees to the prevailing parties, and that the award of monetary discovery sanctions should have been reversed and remanded for further proceedings. Monterey County Water Resources Agency (MCWRA) is a flood control and water agency. Coastkeeper sued, alleging that MCWRA had violated the Porter-Cologne Water Quality Control Act (Wat. Code 13000) by failing to report to the regional water quality board its discharges of agricultural pollutants into the Reclamation Ditch and the Blanco Drain and breach of fiduciary duty under the public trust doctrine. The trial court granted the petition as to the claim of failure to report waste discharge and denied it as to breach of fiduciary duty, commanding MCWRA “to prepare and file a report of waste discharge ... with the Central Coast Regional Water Quality Control Board.” The court of appeal reversed, finding that Coastkeeper failed to exhaust its administrative remedy under the Act, which provides that any person aggrieved by a regional water board’s action or failure to act is entitled to administrative review by the State Water Board, and then by petition for administrative mandamus in the superior court. The regional board was apparently investigating MCWRA's actions; Coastkeeper failed to file a petition for review with the State Water Board of the regional board’s action or failure to act with regard to MCWRA’s alleged waste discharges. Philip Hudson appealed a district court’s grant of partial summary judgment in favor of the State of Idaho, the Idaho State Board of Land Commissioners and the Idaho Department of Lands (collectively, the “State”). The district court found that Hudson violated the Idaho Lake Protection Act (the “LPA”) when he placed fill in the bed of Priest Lake without a permit. Hudson disputed the location of the Ordinary High Water Mark (the “OHWM”) and argued the fill was placed on his own property to protect it from erosion. Hudson argued that there was an issue of material fact regarding the location of the OHWM, which made summary judgment improper. Finding the dispute regarding the OHWM was not a material fact in determining whether Hudson violated the LPA, the Idaho Supreme Court affirmed summary judgment. View "Idaho Board of Land v. At issue in this matter was landowners’ recourse against an irrigation district for diverting a portion of their water source to other landowners within the district. The appellants-landowners owned farms in Jerome County; A&B Irrigation District (the “District”) distributed water to these farms and others throughout its service area in Jerome and Minidoka Counties. The District serves two distinct sub-areas in its district: Unit A and Unit B. The water the District distributes comes from two sources: (1) surface water from the Snake River and associated reservoirs, and (2) groundwater from the Eastern Snake Plain Aquifer. These two water sources were historically what separated Units A and B, and many owners based their land choices in the 1950s on the water source. Unit A farms have received surface water exclusively since the District’s inception. For decades Unit B farms received only groundwater, but the District converted approximately 1400 Unit B acres to surface water in the 1990s in response to decreasing groundwater supply. Appellants claimed the Project primarily benefited Unit B landowners at the expense of Unit A by diverting a portion of Unit A’s sole water source (surface water) onto Unit B land and “diluting” their annual water supply. Additionally, the District divided Project costs equally among all landowners despite what Appellants claim was the Project’s primary purpose: to help sustain Unit B farms as their groundwater supply continues to decline. The landowners brought an action for a declaratory judgment regarding their constitutional water and property rights. They also sought injunctive relief against the irrigation district for a breach of fiduciary duty. The district court granted the irrigation district’s motion to dismiss on all three of the landowners’ claims. The landowners’ appeal centered on two issues with respect to their three claims against the District: the legal standard under which the district court dismissed Appellants’ claims, and the court’s substantive determinations under that standard. Appellants contend the district court erred both procedurally and substantively in dismissing all three counts in its amended complaint. Procedurally, they claimed the district court improperly considered matters outside the pleadings in dismissing all three claims under Rule 12(b)(6), rather than converting to the Rule 56 summary judgment standard. Substantively, Appellants contended that Counts I and III were justiciable as presented on the face of their amended complaint, and that res judicata did not bar relief under Count II. The Idaho Supreme Court found after review that the landowners failed to demonstrate justiciable claims in their Counts I and III, and that the district court erred in dismissing their property rights claim in Count II by considering matters outside the pleadings under Rule 12(b)(6). Allco Renewable Energy Ltd. (Allco) appealed the denial of its motion to intervene, and its renewed motion to intervene, in a certificate-of-public-good (CPG) proceeding for a solar electric generation facility. The applicant, GMPSolar–Richmond, LLC (GMPSR), was an affiliate of Green Mountain Power Corp. (GMP), an electricity utility, owned by GMP and an investor. Allco was developing a number of solar electric generation facilities in Vermont. A hearing officer denied Allco’s request for intervention as of right and permissive intervention; the Public Service Board (PSB) also denied the motion for reconsideration. On appeal to the Vermont Supreme Court, Allco argued PSB used the wrong framework in reviewing its request and incorrectly applied the intervention criteria. After the San Diego Association of Governments (SANDAG) certified an environmental impact report (EIR) for its 2050 Regional Transportation Plan/Sustainable Communities Strategy (transportation plan), CREED-21 and Affordable Housing Coalition of San Diego filed a petition for writ of mandate challenging the EIR's adequacy under the California Environmental Quality Act (CEQA). Cleveland National Forest Foundation and the Center for Biological Diversity filed a similar petition, in which Sierra Club and the State later joined. The superior court granted the petitions in part, finding the EIR failed to carry out its role as an informational document because it did not analyze the inconsistency between the state's policy goals reflected in Executive Order S-3-05 (Executive Order) and the transportation plan's greenhouse gas emissions impacts after 2020. The court also found the EIR failed to adequately address mitigation measures for the transportation plan's greenhouse gas emissions impacts. The California Supreme Court granted review on the sole issue of whether the EIR should have analyzed the transportation plan's impacts against the greenhouse gas emission reduction goals in the Executive Order and reversed the Court of Appeal "insofar as it determined that the [EIR's] analysis of greenhouse gas emission impacts rendered the EIR inadequate and required revision." Cleveland and the State requested the Court of Appeal keep the remainder of its decision substantially intact and publish it as revised. SANDAG asserted the case was moot because the EIR and the transportation plan have been superseded by more recent versions, which Cleveland and the State did not challenge. The Court of Appeal agreed with Cleveland and the State that SANDAG did not establish this case was moot. The Court exercised its discretion and reversed to the extent the superior court determined the EIR failed to adequately analyze the transportation plan's greenhouse gas emissions impacts. The judgment was affirmed to the extent the superior court determined the EIR failed to adequately address the mitigation measures for the transportation plan's greenhouse gas emissions impacts. The judgment was modified to incorporate this court's decision on the cross-appeals. The matter was remanded to the superior court with directions to enter a modified judgment and order the issuance of a peremptory writ of mandate conforming to the Supreme Court's decision in Cleveland II and to this court's decision on remand. CEH filed a complaint in Alameda County alleging violation of the California Safe Drinking Water and Toxic Enforcement Act, Health and Safety Code section 25249.5 (Proposition 65) by failing to warn individuals who live or work in the Kern County town of Shafter that a soil fumigant manufactured by Dow contains a chemical known to cause cancer. Dow moved to transfer the case to Kern County, where the cause of action arose, citing Code of Civil Procedure section 393(a). The trial court denied held that venue is proper in any county under section 395(a) because Dow is a nonresident defendant with no principal place of business in California. The court of appeal disagreed, concluding that section 393(a) establishes that proper venue is in Kern County, where the cause of action arose.The “main relief rule” does not apply because the complaint allegations do not implicate real property rights; it is not necessary to determine whether the relief sought is primarily local and governed by section 392. A Proposition 65 private enforcement action does not fit within the class of cases characterized as transitory because the plaintiff is not seeking recompense for personal harm. An action for equitable relief under such a statute falls within the express language of section 393(a) when, as here, the plaintiff seeks a statutory penalty. View "Dow Agrosciences LLC v. Conecuh Timber, Inc., Ayres Forestry, Inc., BAR Forest Products, LLC, Dry Creek Loggers, Inc., Pea River Timber Company, Inc., Pineville Timber Co., LLC, and THE Timber Company, LLC ("TTC") (collectively referred to as "the wood dealers"), sued Alabama River Group, Inc. ("ARG"), and ARG's chairman and chief executive officer George Landegger, asserting various claims arising from transactions between the wood dealers and ARG's predecessors; the transactions were affected by a short-lived subsidy program administered by the United States Department of Agriculture's Farm Service Agency ("the FSA") known as the Biomass Crop Assistance Program ("BCAP"). Following a jury trial, a judgment was entered against the ARG defendants awarding the wood dealers $1,092,692.71 in compensatory damages and $7,000,000 in punitive damages. The trial court reduced the punitive-damages award by virtue of the statutory cap in section 6- 11-21, Ala. Code 1975, resulting in a total judgment of $6,395,489.37. The ARG defendants filed post-trial motions, which, after a hearing, the trial court denied. The ARG defendants appealed. After review, the Alabama Supreme Court affirmed the trial court's judgment as to liability and compensatory damages. The Court affirmed the punitive damages awarded to Dry Creek Loggers, Inc., and to Conecuh Timber, Inc. With respect to the punitive-damages awards of the remaining wood dealers, the judgment of the trial court was affirmed on the condition that those wood dealers file a remittitur of the punitive-damages awards to a 3:1 ratio to the Supreme Court. Should any wood dealer fail to timely file the respective remittitur, the judgment as to that wood dealer would be reversed and the cause remanded for a new trial. View "Alabama River Group, Inc. v. At issue before the Vermont Supreme Court in this appeal was whether land dedicated to a public use could be condemned for another public use when the new use did not materially interfere with the prior use. Intervenors, a group of Hinesburg residents who use Geprags Park, appealed the Public Service Board’s order authorizing Vermont Gas Systems, Inc. (VGS) to condemn an easement through the park for the purpose of installing a natural gas pipeline. They argued the Board erred in authorizing the condemnation in light of the fact that the park was already dedicated to a public use, and in concluding that the condemnation was necessary under 30 V.S.A. section 110(a)(2). The Supreme Court affirmed the Board’s decision, but remanded for a minor correction to the order relating to the terms of the easement. View "In re Vermont Gas Systems, Inc." on Justia Law

In cases consolidated for review, the issue presented for the Tenth Circuit centered on whether the Bureau of Land Management (BLM) acted beyond its statutory authority when it promulgated a regulation, 43 C.F.R. sec. 3162.3-3 (2015), governing hydraulic fracturing (fracking) on lands owned or held in trust by the United States. The district court invalidated this regulation as exceeding the BLM’s statutory authority. While these appeals were pending, a new President of the United States was elected, and shortly thereafter, at the President’s direction, the BLM began the process of rescinding the Fracking Regulation. Given these changed and changing circumstances, the Tenth Circuit concluded these appeals were unripe for review. As a result, the Court dismissed these appeals and remanded with directions to vacate the district court’s opinion and dismiss the action without prejudice. View "Wyoming v. Zinke" on Justia Law
