Alaska, Office of Lieutenant Governor, Division of Elections v. Arctic Village Council, et al.
About two months before the 2020 general election, a village government, a nonpartisan political organization, and two individual Alaska voters sought to enjoin the State from enforcing a statute that required absentee ballots to be witnessed by an official or other adult. They argued that, under the unusual circumstances posed by the COVID-19 pandemic, the witness requirement unconstitutionally burdened the right to vote. The superior court granted a preliminary injunction, concluding that the State’s interests in maintaining the witness requirement were outweighed by the burden that requirement would impose on the right to vote during times of community lockdowns and strict limits on person-to-person contact. The court also rejected the State’s laches defense, reasoning that the unpredictability of the pandemic’s course made it reasonable for the plaintiffs to wait as long as they did before filing suit. The State petitioned for review. After an expedited oral argument the Alaska Supreme Court affirmed the superior court’s decision, finding no abuse of discretion. Thompson v. DeWine
Plaintiffs are three Ohioans who tried to get initiatives to decriminalize marijuana on local ballots. Soon after they filed their proposed initiatives for November 2020 ballots, Ohio declared a state of emergency because of COVID-19 and ordered Ohioans to stay at home. Ohio’s ballot-access laws require the submission of a petition with a minimum number of ink signatures witnessed by the petition’s circulator. Plaintiffs say the laws, as applied during the COVID-19 pandemic, made it too difficult for them to get any of their initiatives on 2020 ballots. They sought declaratory and injunctive relief but tied their requests for relief exclusively to the November 2020 election. The Sixth Circuit affirmed the dismissal of the case. The election has come and gone and, with it, the prospect that plaintiffs can get any of the relief they asked for. The case is moot. View "Thompson v. DeWine" on Justia Law
Andreacchio v. Coleman
Richard and Stacy Andreacchio invoked Mississippi Code Section 23-15-951 (Rev. 2018), not to challenge the determination that the Republican candidate, Kassie Coleman, received more legal votes than her Democrat opponent in the November 2019 election for district attorney of the Tenth Circuit District. The Andreacchios conceded Coleman won her election. However, they contended Coleman was not qualified to run in the first place. The Mississippi Supreme Court concluded the trial court did not err in dismissing the Andreacchios complaint: the mechanism to challenge a candidate who was qualified to run for his or her political party’s nomination was provided in Mississippi Code Section 23-15-961 (Rev. 2018). Alaska Division of Elections v. Recall Dunleavy
A recall committee submitted an application to the Alaska Division of Elections seeking to recall the governor, citing lack of fitness, incompetence, and neglect of duties as grounds. The director refused to certify the application, asserting that it was not legally or factually sufficient. The committee challenged the director’s decision in superior court. That court granted summary judgment for the committee, deciding that except for one allegation, which it struck, the allegations in the committee’s application were legally and factually sufficient. The committee was allowed to move on to the second phase of signature-gathering on its recall petition; if it was successful, the director would call a special election to allow the voters to decide whether the governor should be recalled. The State appealed, and the Alaska Supreme Court affirmed the superior court’s decision in a summary order with an opinion to follow. Alaska Division of Elections v. Galvin
Alyse Galvin was an Alaska Democratic Party nominee for office, but registered as a nonpartisan voter. She sued to stop the state Division of Elections from sending out already-printed ballots for the 2020 general election, arguing that the Division’s ballot design, by omitting her nonpartisan voter registration, violated both a statutory directive to designate a candidate’s party affiliation on the ballot and Galvin’s right to free political association under the Alaska Constitution. After the superior court issued a temporary restraining order, the Division petitioned for review. But the following day, the superior court denied Galvin’s request for a preliminary injunction; the Alaska Supreme Court granted her emergency cross-petition for review and affirmed the superior court’s decision in a summary order with this explanation to follow.
The Court concluded the Division’s evidence supported the superior court’s factual finding that granting Galvin’s requested injunction would have jeopardized the prospects of a successful and timely election. The superior court did not abuse its discretion by denying Galvin’s requested preliminary injunction because granting the injunction could have imperiled the public interest in an orderly and timely election. Harreld v. Banks
Jim Harreld and Karl Banks ran for the position of District 4 Supervisor in Madison County, Mississippi. Banks won the November 5, 2019 election by fifty-seven votes. The Madison County Election Commission certified Banks as the winner of the election. Harreld challenged the election and asked the trial court to order a special election or to declare him the winner of the November election. The Madison County Circuit Court affirmed the election as certified. Harreld appealed. Finding no reversible error in the circuit court's order, the Mississippi Supreme Court affirmed. North Carolina State Conference of the NAACP v. Berger
At issue in this appeal is whether the leaders of the North Carolina House and Senate are entitled to intervene, on behalf of the State of North Carolina, in litigation over the constitutionality of the State's voter-ID law. North Carolina's Attorney General, appearing for the State Board of Elections, already is representing the State's interest in the validity of that law, actively defending its constitutionality in both state and federal court. Legislative Leaders moved twice to intervene so that they also can speak for the State.The en banc court affirmed the district court's denial of the Leaders' renewed request for intervention. The en banc court explained that, at this point in the proceedings, the legislative leaders may assert only one interest in support of intervention: that of the State of North Carolina in defending its voter-ID law. The en banc court further explained that it follows that they have a right to intervene under Federal Rules of Civil Procedure 24(a)(2) only if a federal court first finds that the Attorney General is inadequately representing that same interest, in dereliction of his statutory duties – a finding that would be "extraordinary." In this case, after reviewing the district court's careful evaluation of the Attorney General's litigation conduct, the en banc court is convinced that the district court did not abuse its discretion in declining to make that extraordinary finding here. The en banc court concluded that this is enough to preclude intervention as of right under Rule 24(a)(2). Citizens for Responsibility v. Federal Election Committee
CREW filed a citizen complaint with the Federal Election Commission against New Models, a now-defunct non-profit entity, alleging violations of the Federal Election Campaign Act’s (FECA) registration and reporting requirements for “political committees,” 52 U.S.C. 30109(a)(1). After an initial investigation, the Commission deadlocked 2–2 on whether to proceed; an affirmative vote of four commissioners is required to initiate enforcement proceedings. With only two votes in favor of an enforcement action against New Models, the Commission dismissed CREW’s complaint. Two Commissioners explained that New Models did not qualify as a “political committee” under FECA but stated they were also declining to proceed with enforcement in an "exercise of ... prosecutorial discretion,” given the age of the activity and the fact that the organization appears no longer active.The district court granted the Commission summary judgment, reasoning that a nonenforcement decision is not subject to judicial review if the Commissioners who voted against enforcement “place[] their judgment squarely on the ground of prosecutorial discretion.” The Commission’s “legal analyses are reviewable only if they are the sole reason for the dismissal of an administrative complaint.” The D.C. Circuit affirmed. While FECA allows a private party to challenge a nonenforcement decision by the Commission if it is “contrary to law,” this decision was based in part on prosecutorial discretion and is not reviewable. In Re: Nom. s. of Major, R.
The issue presented for the Pennsylvania Supreme Court's review required the Court to revisit its relatively recent holding that the signature of a registered voter “may not be stricken from a nominating petition solely because the address set forth on the nominating petition is different from the address at which the signer is currently registered to vote.” Following the Court's unanimous decision in In re Vodvarka, 140 A.3d 639 (Pa. 2016), the General Assembly in October of 2019 enacted Act 77, which made significant changes to Pennsylvania’s Election Code, such as the advent of no-excuse mail-in voting. One lesser-known change effected by Act 77 was the amendment of 25 P.S. section 2868, which required a signer of a nominating petition to add certain information. Significantly, only one change was made to the statute by the amendment: the former requirement that a signer add his “residence” was replaced with a new requirement that he add the “address where he is duly registered and enrolled.” After careful review, the Supreme Court concluded this legislative change in statutory text displaced the Court's holding in Vodvarka pertaining to the address requirement. Furthermore, the Court concluded the statute as amended, plainly and unambiguously imposed a mandatory duty on a signer of a nominating petition to add the address where he or she was duly registered and enrolled, and that the failure to comply with this requirement exposes the signature to viable legal challenge. In re Recall of Sawant
Kshama Sawant served on the Seattle City Council since 2013. Ernest Lou, among others, filed recall charges alleging that Councilmember Sawant delegated city employment decisions to a political organization outside city government, used city resources to promote a ballot initiative and failed to comply with public disclosure requirements, disregarded state orders related to COVID-19 and endangered the safety of city workers and other individuals by admitting hundreds of people into Seattle City Hall while it was closed to the public, and led a protest march to Mayor Jenny Durkan’s private residence, the location of which Councilmember Sawant knew was protected under state confidentiality laws. The trial court found these charges factually and legally sufficient for recall. Councilmember Sawant challenged the ballot synopsis. The Washington Supreme Court determined petitioner’s charges that Councilmember Sawant delegated city employment decisions to a political organization outside city government and a portion of the charge that Councilmember Sawant’s actions in divulging the location of Mayor Durkan’s private residence amounted to criminal harassment in violation of RCW 9A.46.020 were legally insufficient. The Court affirmed in all other respects, and declined to address the Councilmember's challenge to the ballot synopsis, because RCW 29A.56.140 provided that “[a]ny decision regarding the ballot synopsis by the superior court is final.” View "In re Recall of Sawant" on Justia Law
