Harbour v. Tupelo Public School District
Following a disciplinary proceeding, Meloney Harbour’s minor son, T.D.H., was suspended from school and placed in an alternative school. The chancery court initially reversed and rendered the decision of the Tupelo Public School District Board of Trustees after finding that the deprivation of an attorney at the initial disciplinary hearing, as well as the failure to state the applicable standard of proof, violated T.D.H.’s due process rights. After a Mississippi Rule of Civil Procedure 59(a) motion, the chancery court amended its judgment to remand the case instead of rendering it. Harbour then filed a Mississippi Rule of Civil Procedure 60(b) motion and, for the first time, challenged the constitutionality of Mississippi Code Section 37-9-71. Harbour contended the statute contained an unconstitutional standard of proof: substantial evidence rather than clear and convincing evidence. Harbour did not notice the attorney general of the constitutional challenge to the statute. Finding that Harbour failed to meet her burden under Rule 60(b), the chancery court denied the motion. Harbour then appealed that ruling. Finding no reversible error, the Mississippi Supreme Court affirmed the chancery court’s denial of the Rule 60(b) motion. View "Harbour v. R.F. v. Harrison School District No. 2
Defendant-Appellant Harrison School District No. 2 asks us to reverse the district court’s ruling that it violated the Individuals with Disabilities Education Act (IDEA) by failing to provide Plaintiff-Appellee Steven R.F. with a free appropriate public education. The Tenth Circuit concluded this case was moot “[b]ecause the status quo remained in effect from the time [the parents] challenged the school district’s attempt to modify the IEP, they de facto received the relief they originally sought . . . ; the modified IEP never took effect.” And there was no evidence that the asserted IDEA violation was likely to occur again. City of Golden v. Sodexo America, LLC
The Colorado School of Mines contracted with Sodexo America, LLC, to fulfill its obligations to provide meals and food options for its students. During the time at issue, Mines loaded each meal-plan student’s student identification card, with an individual meal plan choice. To use their meal plans, students swiped their “BlasterCards” at a dining facility. Sodexo had nothing to do with loading the students’ BlasterCards with their meal plans; Sodexo also had no way of knowing if a student had fully paid for his or her meal plan, and Sodexo had no way of enforcing collections against a student who hadn’t fully paid. Neither Mines nor Sodexo collected any sales tax on these meal-plan meals. When the City of Golden’s Finance Department audited Sodexo and discovered that sales tax for these meal plans had not been collected, it issued a sales and use tax assessment. Sodexo protested and lost, so Sodexo appealed to the district court. The court granted summary judgment for Golden, finding that Sodexo had engaged in taxable retail sales directly to Mines’ students, rather than tax-exempt wholesale sales to Mines. Sodexo appealed again. This time, a unanimous division of the court of appeals reversed the judgment of the district court, concluding that there were two sales transactions at issue: one between Mines and Sodexo, and the other between Mines and its students. The division further concluded that Mines and Sodexo were engaged in tax-exempt wholesale transactions. Accordingly, the division remanded for entry of judgment in Sodexo’s favor. The Colorado Supreme Court granted the City of Golden’s request to review the appellate court’s decision. After review, the Court agreed that two transactions took place. Like the division below, the Court concluded Sodexo sold the meal-plan meals to Mines at wholesale, and, accordingly, these transactions were exempt from taxation under the Code. Farmer v. Kansas State University
Plaintiffs Tessa Farmer and Sara Weckhorst, two students at Kansas State University (“KSU”), alleged KSU, a recipient of federal educational funds, violated Title IX by being deliberately indifferent to reports it received of student-on-student sexual harassment which, in this case, involved rape. Plaintiffs alleged KSU violated Title IX’s ban against sex discrimination by being deliberately indifferent after Plaintiffs reported to KSU that other students had raped them, and that deliberate indifference caused Plaintiffs subsequently to be deprived of educational benefits that were available to other students. At the procedural posture presented by these interlocutory appeals, which addressed the denial of KSU’s motions to dismiss, the Tenth Circuit Court of Appeals accepted as true Plaintiffs’ factual allegations indicating that KSU was deliberately indifferent to their rape reports. Accepting that premise, the legal question presented to the Court was what harm Plaintiffs had to allege KSU’s deliberate indifference caused them. The Tenth Circuit concluded that, in this case, Plaintiffs sufficiently alleged that KSU’s deliberate indifference made each of them “vulnerable to” sexual harassment by allowing their student-assailants (unchecked and without the school investigating) to continue attending KSU along with Plaintiffs. “This, as Plaintiffs adequately allege, caused them to withdraw from participating in the educational opportunities offered by KSU.” The Court affirmed the district court’s decision to deny KSU’s Fed. Laker v. Board of Trustees of the California State University
A student approached Professor Laker, claiming that the department chair, Aptekar, had harassed her. The student brought a formal Title IX complaint. An investigator concluded that Aptekar had sexually harassed the student. Aptekar was disciplined but was allowed to remain as department chair for several weeks. Aptekar was later placed on paid leave. Laker claims that the University and certain administrators, including McVey, covered up prior student complaints about Aptekar. In February 2016, various administrators received an e-mail from the student who had originally filed the Title IX complaint, stating she was experiencing stress from continuing to see Aptekar. The University then investigated Laker based on complaints of “inspiring students to come forward to report sexual and racial harassment by Aptekar.” Laker sued, alleging defamation and retaliation The defendants filed an anti-SLAPP (strategic lawsuit against public participation) motion to strike, Code of Civil Procedure 425.16. The court of appeal reversed the denial of the motion as to defamation. Statements Laker identified as defamatory were part of the protected activity of the Aptekar investigation. On remand, the trial court is directed to strike certain language and the claims it supports from the retaliation claim: “publishing false and defamatory statements about Laker to punish him for his ongoing efforts to protect SJSU students from sexual harassment by Aptekar, with the intent of scapegoating Laker as the person who had failed to report Aptekar’s misconduct.” View "Laker v. In re B.B., B.C., and B.B., Juveniles
Mother appealed an order concluding that her children were children in need of care or supervision (CHINS) due to educational neglect. In April 2018, the State filed a petition alleging that B.C., born in January 2007, Bo.B., born in May 2012, and Br.B., born in April 2013, were CHINS for lack of proper education necessary for their well-being. B.C. had been referred to an educational support team because she was not meeting certain achievement levels in her educational program. In prior years, there had been three educational neglect/truancy assessments involving B.C. In January 2018, the assistant principal reported to the Department for Children and Families (DCF) that B.C. had missed twenty-two days and Bo.B. had missed thirty-two days of school and all absences were unexcused. By March 2018, B.C. and Bo.B. had missed thirty-eight and fifty days of school, respectively. DCF contacted mother, who asserted that the absences were occurring because she was not receiving sufficient support from the school, the children were often absent due to illness, and transportation was a barrier. When asked, mother did not appear to understand the details of Bo.B.’s Individualized Education Plan (IEP). DCF set up a plan to implement services through NCSS in March, however, mother cancelled the meeting. The court found that the three children were CHINS due to the parents’ inability to provide for the children’s educational needs. The court found that the children’s absences resulted in missed educational opportunities that put them at risk of harm, especially in light of their needs. On appeal, mother argued: (1) the court erred in not requiring the State to demonstrate that the children’s absences were without justification; (2) the evidence did not support the court’s finding that missing school caused the children harm; (3) the existence of IEPs for the two young children, who were not legally required to attend school, did not support a finding of educational neglect; and (4) the court erred in admitting the school attendance records. The Vermont Supreme Court affirmed as to B.C. and reversed and remanded the CHINS determinations as to Bo.B. and Br.B. "[T]he evidence was insufficient to demonstrate that Bo.B. and Br.B. were at risk of harm for educational neglect given that they were not required to attend school and mother could discontinue the services related to their IEPs without any presumption of neglect." Citizens for Strong Schools, Inc. v. State Board of Education
The Supreme Court approved the result reached by the First District Court of Appeal affirming the trial court’s rejection of Petitioners’ challenge to the State’s K-12 public education system based on the State’s alleged failure to comply with Fla. Const. art. IX, 1(a), holding that Coalition for Adequacy & Fairness in School Funding, Inc. v. Chiles (Coalition), 680 So. 2d 400 (Fla. 1996) defeated Petitioners’ claim.In their complaint, Petitioners sought a declaration that the State was breaching its duty to make adequate provision for an “efficient” and “high quality” system of free public schools that allows students to obtain a high quality education. Petitioners requested that the courts order the State to establish a remedial plan including studies to determine what resources are necessary to provide a high quality education to Florida students. The trial court rejected Petitioners’ challenge, and the court of appeal affirmed. The First Circuit affirmed, holding that because Petitioners failed to present any manageable standard by which to avoid judicial intrusion into the powers of the other branches of government, the court of appeal properly affirmed the trial court’s rejection of Petitioners’ blanket challenge to the adequacy of the funding of the entire K-12 education system. Mackey v. Bd. of Trustees of the Cal. State University
Five African-American women on the basketball team at California State University at San Marcos (CSUSM) sued their head coach and the Board of Trustees of the California State University, claiming the coach engaged in race-based discrimination and retaliation: derogatorily referring to them as "the group," reduced their playing time, afforded them fewer opportunities, punished them more severely and generally singled them out for harsher treatment as compared to their non-African-American teammates. The trial court granted both motions for summary judgment filed by the Board, concluding plaintiff Danielle Cooper's claims were untimely and that the remaining plaintiffs could not show a triable issue on the merits. The Court of Appeal reversed summary judgment and directed the court to enter a new order granting summary adjudication on some, but not all, of plaintiffs' claims: plaintiffs cannot sue the Board under 42 United States Code sections 1981 and 1983 because CSUSM was not a "person" subject to suit under those statutes. With regard to the remaining claims brought by the four "freshmen plaintiffs," summary adjudication was improper as to their racial discrimination claims under title VI of the Civil Rights Act of 1964 and the Unruh Civil Rights Act. The Board did not meet its moving burden to show the lack of a triable issue as to whether these plaintiffs suffered a materially adverse action under circumstances suggesting a racially discriminatory motive. For similar reasons, summary adjudication was improper on title VI retaliation claims brought by three of the four freshmen plaintiffs, Lynette Mackey, Kianna Williams, and Sierra Smith: each of these women complained about the coach's discriminatory treatment and indicated how they suffered adverse consequences as a result. The Court reached a different conclusion as to plaintiff Crystal Hicks, who never made a complaint and denied facing any consequences as a result of complaints made by her peers. View "Mackey v. Ricasa v. Office of Admin. Hearings
Southwestern Community College District (District) and its governing board (Board) (together Southwestern) demoted Arlie Ricasa from an academic administrator position to a faculty position on the grounds of moral turpitude, immoral conduct, and unfitness to serve in her then-current role. While employed by Southwestern as the director of Student Development and Health Services (DSD), Ricasa also served as an elected board member of a separate entity, the Sweetwater Union High School District (SUHSD). The largest number of incoming District students were from SUHSD, and the community viewed the school districts as having significant ties. As a SUHSD board member, Ricasa voted on million-dollar vendor contracts to construction companies, such as Seville Group, Inc. (SGI) and Gilbane Construction Company, who ultimately co-managed a bond project for the SUHSD. Before and after SGI received this contract, Ricasa went to dinners with SGI members that she did not disclose on her Form 700. Ricasa's daughter also received a scholarship from SGI to attend a student leadership conference that Ricasa did not report on her "Form 700." In December 2013, Ricasa pleaded guilty to one misdemeanor count of violating the Political Reform Act, which prohibited board members of local agencies from receiving gifts from a single source in excess of $420. Ricasa filed two petitions for writs of administrative mandamus in the trial court seeking, among other things, to set aside the demotion and reinstate her as an academic administrator. Ricasa appealed the denial of her petitions, arguing the demotion occurred in violation of the Ralph M. Brown Act (the Brown Act) because Southwestern failed to provide her with 24 hours' notice of the hearing at which it heard charges against her, as required by Government Code section 54957. Alternatively, she argued the demotion was unconstitutional because no nexus existed between her alleged misconduct and her fitness to serve as academic administrator. Southwestern also appealed, arguing that the trial court made two legal errors when it: (1) held that Southwestern was required to give 24-hour notice under the Brown Act prior to conducting a closed session at which it voted to initiate disciplinary proceedings, and (2) enjoined Southwestern from committing future Brown Act violations. The Court of Appeal concluded Southwestern did not violate the Brown Act, and that substantial evidence supported Ricasa's demotion. School Dist. No. 1 v. Denver Classroom Teachers Ass’n
Believing that the decision to stop paying teachers for English Learning Acquisition (ELA) training violated a series of the parties’ Collective Bargaining Agreements (CBAs), the Denver Classroom Teachers Association (DCTA) pursued a grievance against the District that was referred to nonbinding arbitration and resulted in a recommendation in favor of the DCTA. Because the District declined to adopt that recommendation, however, the DCTA brought this suit asserting a breach-of-contract claim against the District. The trial court ruled that the relevant provisions of the CBAs were ambiguous and that their interpretation was, therefore, an issue of fact for the jury. The jury, in turn, found the District liable for breach of contract and awarded damages to the DCTA. A division of the court of appeal subsequently affirmed the judgment of the trial court. After its review, the Colorado Supreme Court concluded interpretation of the CBAs was properly submitted as an issue of fact to the jury because the CBAs were ambiguous regarding payment for ELA training. “[B]ecause the CBAs are fairly susceptible to being interpreted as expressly requiring compensation for ELA training, we cannot conclude that the management rights clause includes the right to refuse to pay for ELA training.” View "School Dist.
