Hogan v. Southern Methodist Univ
Plaintiff, on behalf of a putative class of students, sued Southern Methodist University (“SMU”) for refusing to refund tuition and fees after the university switched to remote instruction during the COVID-19 pandemic. The district court dismissed Plaintiff’s complaint for failure to state a claim.
The Fifth Circuit reversed that decision in light of King v. Baylor University, 46 F.4th 344 (5th Cir. 2022), which was issued after the district court’s ruling and which teaches that Hogan adequately pled a breach-of-contract claim. Alternatively, the district court held that Texas’s Pandemic Liability Protection Act (“PLPA”) retroactively bars Plaintiff’s claim for monetary relief and is not unconstitutionally retroactive under the Texas Constitution. That latter ruling raises a determinative-but-unsettled question of state constitutional law, which the court certified to the Texas Supreme Court: Does the application of the Pandemic Liability Protection Act to Plaintiff’s breach-of-contract claim violate the retroactivity clause in article I, section 16 of the Texas Constitution? Nigel B. v. Burbank Unified Sch. Dist.
After sustaining a knee injury during a mandatory eighth-grade physical education class’s touch football unit, Plaintiff sued, among others, defendants Burbank Unified School District (the District) and his physical education teacher. A jury returned verdicts in Plaintiff’s favor against Defendants, finding that the District breached a mandatory duty under the Education Code, the teacher was negligent, and Plaintiff suffered resulting harm. Defendants appealed from the judgment, contending: there was insufficient evidence that the District’s breach of a mandatory duty proximately caused Plaintiff’s injury; the special verdict form was fatally defective because it failed to specify whether the District’s breach of a mandatory duty or the teacher’s negligence was a substantial factor in causing Plaintiff’s injuries; the trial court erred by failing to instruct the jury on the primary assumption of risk doctrine; and the court erred by not allowing the jury to apportion fault to the student who ran into Plaintiff (the Student), thus precluding Defendants from reducing liability for noneconomic damages.
The Second Appellate District reversed and remanded for the trial court to enter judgment in favor of the District and to hold a new trial limited to the issue of apportionment of fault between the teacher and student. The court explained that the Student’s act of intentionally running into Plaintiff was a substantial causative factor in Plaintiff’s injury and the teacher, therefore, should have been entitled to seek allocation of fault pursuant to Civil Code section 1431.2.11 Because the trial court failed to instruct the jury on comparative fault principles, the court remanded for retrial on the apportionment of fault. Eva Palmer v. Liberty University, Incorporated
In consolidated appeals, Plaintiff challenged the district court’s award of summary judgment to defendant Liberty University, Inc. (“Liberty”) on Palmer’s claim of age discrimination, pursued under provisions of the Age Discrimination in Employment Act (the “ADEA”) (the “Statutory Ruling”). On the other hand, Liberty, by cross-appeal, challenged an earlier award of summary judgment that was made to Plaintiff, in which the court ruled that Plaintiff was not a “minister” for purposes of the First Amendment’s so-called “ministerial exception” (the “Constitutional Ruling”).
The Fourth Circuit affirmed the Statutory Ruling, dismissed Liberty’s cross-appeal, and vacated the Constitutional Ruling. The court explained that it agreed with the district court that Plaintiff failed to produce sufficient evidence of age-based discrimination to overcome Liberty’s summary judgment motion on that issue. Accordingly, the court was satisfied to affirm the Statutory Ruling in favor of Liberty. Moreover, in light of that disposition — and pursuant to the constitutional avoidance doctrine — the court refrained from resolving whether Plaintiff was a minister for purposes of the First Amendment’s ministerial exception. Heston v. Austin Indep
Plaintiff sued the Austin Independent School District (“AISD”) on behalf of her minor son, A.H., alleging that AISD violated Section 504 of the Rehabilitation Act of 1973, the Americans with Disabilities Act (“ADA”), and 42 U.S.C. Section 1983by employing an individual assigned to help A.H. accommodate his disabilities, but who instead verbally harassed him and threw a trash can at him, hitting him and causing injury. After the incident, the parties settled all of A.H.’s Individuals with Disabilities Education Act (“IDEA”) claims outside of court but agreed that Plaintiff still had the right to file a separate action containing A.H.’s claims arising under Section 504, the ADA, and Section 1983. Heston then brought these claims in a suit filed in 2018. The district court dismissed the suit without prejudice for Plaintiff’s failure to exhaust the Individuals with Disabilities Education Act’s (“IDEA”) administrative remedies.
The Fifth Circuit vacated the district court’s judgment and remanded it to the district court for further consideration in light of Luna Perez v. Sturgis Pub. Schs., 143 S. Ct. 859 (2023). Since Plaintiff appealed and the Parties’ briefed the case, the Supreme Court decided Luna Perez, concluding that the IDEA does not require administrative exhaustion “where a plaintiff brings a suit under another federal law for compensatory damages.” This constitutes a “modification in controlling legal principles . . . rendering a previous determination inconsistent with the prevailing doctrine.” View "Heston v. H.C. v. NYC DOE, et al.
Appellants in these tandem appeals are each a parent of a disabled child. Arguing that his or her child was entitled to benefits under the Individuals with Disabilities Education Act (“IDEA”), 20 U.S.C. Section 1415(i), each parent brought an administrative action against his or her local education agency and prevailed. Subsequently, each parent brought a federal action for attorneys’ fees pursuant to 20 U.S.C. Section 1415(i)(3)(B). In each case, the district court awarded less attorneys’ fees than the parent requested, and the parents appealed.
The Second Circuit reversed the district court’s denial of travel-related fees in No. 21-1961 and remanded for further proceedings. The court otherwise affirmed the judgments of the district courts. The court found that it was persuaded that there was no abuse of discretion in the district court’s calculation of reasonable attorneys’ fees in each case. Further, the court wrote that the district courts that declined to award prejudgment interest did not abuse their discretion because “delays in payment” may be remedied by “application of current rather than historic hourly rates.” However, the court held that the district court abused its discretion when it denied any travel-related fees to M.D.’s counsel. A district court may permissibly adjust excessive travel costs. But the district court could not “eliminate all of the hours submitted by [CLF] as travel time” by denying travel-related fees altogether. View "H.C. v. NYC DOE, et al." on Justia Law
Q. T. v. Pottsgrove School District
Student H.P.-B. resides with her adult cousin Q.T. within the geographical boundaries of Pottsgrove. H.P.-B. enrolled in Pottsgrove during the 2014–2015 school year. Q.T. does not have legal custody of H.P.-B—an August 2008 order grants primary physical and legal custody to H.P.-B.’s grandmother, E.E. Q.T. filed an IDEA due process complaint on H.P.-B’s behalf. The district court held that a straightforward application of C.F.R. 34 Section 300.30 (b)(2) “dictates that Q.T. does not qualify as H.P.-B.’s ‘parent’ for purposes of the IDEA.” Q.T., E.E., and F.P. appealed the district court’s order. Appellants argued that the district court erred by holding that Q.T. does not qualify as H.P.-B.’s parent for purposes of the IDEA and, thus that Q.T. is unable to file a due process complaint on H.P.-B.’s behalf.
The Third Circuit reversed and remanded. The court explained the district court erred in finding that Q.T. did not qualify as H.P.-B.’s parent and thus lacked standing to file a due process complaint on H.P.-B.’s behalf. The court reversed the district court’s decision and remanded with instructions to vacate the hearing officer’s order dismissing Q.T.’s due process complaint. The court explained there is ample evidence in the record that Q.T. was acting in the place of H.P.-B.’s natural parent, satisfying the third definition of “parent.” The record shows Q.T. affirmed that she was supporting H.P.- B. assumed all personal obligations related to school requirements for H.P.-B. and intended to keep and support H.P.-B. continuously, and not merely through the school year. Z. W. v. Horry County School District
In 2017, when Plaintiff was in elementary school, he was diagnosed with autism spectrum disorder, language disorder, and anxiety. Between 2017 and 2021, Plaintiff's parents asked Defendant School District at least four times to allow Plaintiff to be accompanied at school by an ABA therapist, at no cost to the school district. The school district denied the first three requests and did not respond to the fourth request.Plaintiff's father filed a three-count complaint against the school under the Rehabilitation Act on behalf of his child. The complaint did not mention the Individuals with Disabilities in Education Act. The district court denied Plaintiff's claim based on his failure to exhaust administrative remedies. Plaintiff appealed.The Fourth Circuit held that the district court erred in concluding Plaintiff needed to exhaust administrative remedies under the IDEA before bringing this suit because his complaint was not brought under the IDEA. Borowski v. Kean University
Kean University implements New Jersey’s Policy Prohibiting Discrimination in the Workplace through its Affirmative Action Office, which conducts an investigation and prepares a report. Kean’s Chief of Staff reviews the report and makes a final determination. A final determination by the Chief of Staff may be appealed to the New Jersey Civil Service Commission. In 2016, adjunct professor Borowski was accused of making insensitive in-class statements about gender, immigration status, ethnicity, and religion. The Chief of Staff ruled against her. Borowski’s teaching assignment was terminated.Borowski appealed to the Commission, which recognized that material facts were in dispute, and referred the matter to an ALJ. Before a decision on the ensuing hearing, Kean alerted the ALJ of an intervening Commission decision, holding that adjunct professors were not civil service employees entitled to appeal final determinations of Policy violations. The ALJ dismissed Borowski’s appeal; the Commission affirmed.Instead of appealing in the state-court system, Borowski sued in federal court. The district court relied on Younger abstention to dismiss the case. The Third Circuit vacated. Younger abstention prevents federal court interference with only certain types of state proceedings, such as quasi-criminal civil enforcement actions. An appeal to the New Jersey Civil Service Commission is neither quasi-criminal nor within another category of Younger-eligible proceedings. Another prerequisite for Younger abstention is that the state proceeding must be ongoing; the Commission’s dismissal was final. View "Borowski v. Kean University" on Justia Law
Victor Valley Union High School Dist. v. Super. Ct.
John MM. Doe, by and through his guardian ad litem, C.M. (Doe’s mother), and B.S. (Doe’s father) (collectively real parties in interest), sued petitioner Victor Valley Union High School District (the district) for negligence and other causes of action arising from an alleged sexual assault on Doe while he was a high school student. During discovery, real parties in interest learned video that captured some of the events surrounding the alleged sexual assault had been erased. Real parties in interest moved the superior court for terminating sanctions or, in the alternative, evidentiary and issue sanctions against the district under Code of Civil Procedure section 2023.030. The trial court concluded the erasure of the video was the result of negligence and not intentional wrongdoing, and it denied the request for terminating sanctions. However, the court granted the request for evidentiary, issue, and monetary sanctions because it concluded that, even before the lawsuit was filed, the district should have reasonably anticipated the alleged sexual assault would result in litigation and, therefore, the district was under a duty to preserve all relevant evidence including the video. On appeal, the district argued the trial court applied the wrong legal standard when it ruled the district was under the duty to preserve the video when it was erased and, therefore, that the district was not shielded from sanctions by the safe-harbor provision of section 2023.030(f). The Court of Appeal concluded the safe-harbor provision of section 2023.030(f) did not shield a party from sanctions for the spoliation of electronic evidence if the evidence was altered or destroyed when the party was under a duty to preserve the evidence. The Court found the record supported the trial court’s ruling that the district was on notice that litigation about Doe’s alleged sexual assault was reasonably foreseeable, and therefore, the safe-harbor provision did not apply. The Court granted the real parties’ petition in part and directed the trial court to reconsider whether the form of sanctions imposed were warranted. View "Victor Valley Union High School Dist. v. Colorado v. Center for Excellence in Higher Education
Colorado’s Attorney General and the Administrator of the Colorado Uniform Consumer Credit Code (“UCCC”) (collectively, “the State”) sought to enjoin the respondent corporate entities and individuals that made up the career school known as CollegeAmerica (collectively, “CollegeAmerica”) from engaging in conduct that the State believed to be in violation of Colorado law. Specifically, the State contended that several aspects of CollegeAmerica’s marketing and admissions operations constituted deceptive trade practices under the Colorado Consumer Protection Act (“CCPA”) and that CollegeAmerica’s institutional loan program, “EduPlan,” was unconscionable under the UCCC. The Colorado Supreme Court concluded, as did the division below, that the State’s CCPA civil penalty claims were equitable in nature and thus CollegeAmerica was not entitled to a jury trial on those claims. The Court further concluded the division erred in remanding this case for a new trial without first assessing whether CollegeAmerica had, in fact, had a full and fair opportunity to litigate the issue of significant public impact and, if so, whether the evidence sufficiently established such an impact. Finally, the Court concluded the division correctly determined that CollegeAmerica’s EduPlan loans as a whole were not unconscionable, although the Supreme Court disagreed with the division’s conclusion that individualized evidence regarding the probability of repayment was necessary to establish unconscionability.
