Plaintiffs were landlords that rented property in the City of Portland. Plaintiffs filed a declaratory judgment and injunction action against the city contending, as relevant here, that ORS 91.225 preempted an ordinance passed requiring landlords to pay relocation assistance to displaced tenants in certain circumstances. Plaintiffs argued the ordinance impermissibly created a private cause of action that a tenant could bring against a landlord that violates the ordinance. On review, the Oregon Supreme Court concluded ORS 91.225 did not prevent municipalities from enacting other measures that could affect the amount of rent that a landlord charged or could discourage a landlord from raising its rents. The Court further held that ORS 91.225 did not preempt the city’s ordinance. The Supreme Court also rejected plaintiffs’ contention that the ordinance impermissibly created a private cause of action. This case arose from Rockdale County, Georgia's denial of an application for a permit to build a QuikTrip on property owned by William Corey and U.S. Enterprises, Inc. (the “Owners”), on the ground that the proposed facility was a “truck stop,” which was a prohibited use under the County’s Unified Development Ordinance (“UDO”). After the County’s Board of Adjustment affirmed the denial of the permit, the Owners filed a petition to the Rockdale County Superior Court seeking, among other things, certiorari under OCGA 5-4-1 et seq. The superior court sustained the petition for certiorari, rejecting the County’s argument that the Owners’ lawsuit was barred by res judicata and reversing the Board’s decision on the ground that the UDO’s applicable definition of a “truck stop” was unconstitutionally vague and therefore violated due process under the Georgia Constitution. The Georgia Supreme Court granted County’s application for a discretionary appeal, and the Owners then cross-appealed. The Supreme Court affirmed the superior court’s rejection of the County’s res judicata argument, reversed the part of the superior court’s judgment ruling that the “truck stop” definition was unconstitutionally vague, and remanded the case for further proceedings. Tom Young, Jr., a former circuit judge for the Fifth Judicial Circuit; Ray Martin, a circuit judge for the Fifth Judicial Circuit; Chris May, the Randolph Circuit Clerk; and Marlene Lindley, a former employee in May's office, petitioned the Alabama Supreme Court for a writ of mandamus directing the trial court to dismiss a complaint filed by Danny Foster, an inmate at the Ventress Correctional Facility, on grounds that they were immune from suit, that Foster lacked standing to sue, and that Foster's claims were precluded by the applicable statute of limitations. The Alabama Supreme Court found May and Lindley make no argument that, based on the face of Foster's complaint, they had a clear legal right to a summary judgment on the ground that the applicable statute of limitations barred Foster's claim against them. Moreover, Foster's complaint was devoid of any information from which the Supreme Court could determine that his claim against May and Lindley was untimely. He did not provide the dates on which he submitted his records requests. May and Lindley, therefore, "have not demonstrated that this case falls within the exception recognized in Hodge to the general rule against review by mandamus of the applicability of a statute-of-limitations defense." The Supreme Court granted the defendants' petition insofar as it sought a writ of mandamus directing the trial court to enter a summary judgment in favor of Judge Young and Judge Martin on grounds that all the claims asserted against them by Foster were barred by the doctrine of judicial immunity. The Court denied the petition, however, insofar as it sought a writ of mandamus instructing the trial court to enter a summary judgment in favor of May and Lindley regarding Foster's claim against them under the Open Records Act. Plaintiffs, two American Indian tribes, business entities affiliated with the tribes, and individual tribe members, sued a number of non-tribal cardrooms alleging they were offering banked card games on non-tribal land, in violation of the exclusive right of Indian tribes to offer such games. Based on those allegations, plaintiffs asserted claims for public nuisance, unfair competition, declaratory and injunctive relief, and tortious interference with a contractual relationship and prospective economic advantage. The defendants demurred and, after two rounds of amendments to the complaint, the trial court sustained the third and final demurrer without leave to amend and entered judgment of dismissal. The court ruled that, as governmental entities, the Indian tribes and their affiliated business entities were not “persons” with standing to sue under the unfair competition law (UCL), and were not “private person[s]” with standing under the public nuisance statutes. The court further ruled the business entities and the individual tribe members failed to plead sufficient injury to themselves to establish standing to sue under the UCL or the public nuisance statutes. Although plaintiffs broadly framed the issue on appeal as whether they, as American Indians, had standing to redress their grievances in California state courts, the Court of Appeal determined it was much narrower: whether the complaint in this case adequately plead the asserted claims and contained allegations sufficient to establish the threshold issue of whether any of the named plaintiffs had standing to bring those claims. The Court agreed with the trial court’s conclusion that the complaint did not do so and, therefore, affirmed judgment in favor of the defendants. View "Rincon Band of Luiseno Mission Indians etc. v. A.S. appealed a juvenile court's judgment and order terminating her parental rights to her child, A.S.F. A.S. was appointed counsel when the State petitioned for involuntary termination of her parental rights. The trial court allowed A.S.’s counsel to withdraw after A.S. expressed dissatisfaction with her counsel. The termination hearing was continued and new counsel was appointed. One day before the rescheduled hearing, A.S.’s second counsel moved to withdraw. The judge heard the motion at the termination hearing. There, counsel stated a material breakdown in the attorney-client relationship had occurred. The court granted counsel’s motion on the basis of the treatment A.S. showed to her counsel and the unwillingness of A.S. to work with any attorney the court appointed. The judge found A.S.’s actions to be a voluntary waiver of her right to counsel. Counsel was allowed to leave the courtroom. The hearing proceeded with A.S. without counsel. The juvenile court entered an order terminating parental rights on June 10, 2021. A.S. appealed to the North Dakota Supreme Court 61 days after the initial June 10 order terminating her parental rights was entered. A.S. argues her right to counsel was violated after the court granted her second attorney’s motion to withdraw, leaving A.S. to represent herself at the termination hearing and without advice regarding the process and deadline for appeal. The Supreme Court determined it lacked jurisdiction even to consider a claim that a party failed to timely appeal as a result of a denial of the party’s right to counsel. The First Circuit affirmed the rulings of the district court denying the Commission of the New Hampshire Department of Health and Human Services' motion to dismiss Plaintiffs' complaints against her, holding that Plaintiffs' allegations of error were without merit.Plaintiffs were (1) a class of individuals who claimed to have been held against their will without due process on the basis of a certification of their need for emergency mental health treatment, and (2) a group of hospitals who claimed to have been forced to retain persons certified to be in need of such treatment. The Commissioner moved to dismiss the claims based on Eleventh Amendment immunity and Plaintiffs' asserted lack of standing. The district court denied the motion to dismiss. The First Circuit affirmed, holding that there was no merit to the Commissioner's challenges to the district court's standing and Eleventh Amendment immunity rulings. View "Doe v. Turnage, claiming that on September 21, 2016, he fell from an upper bunk at Cook County Jail and suffered a broken ankle, sought damages under the Americans with Disabilities Act, 42 U.S.C. 12132, and the Rehabilitation Act, 29 U.S.C. 794(a). He argued that the Jail knew that he has seizures but failed to enforce his lower-bunk permit (which had been issued to reduce his risk of falling).Federal law requires prisoners to pursue administrative remedies, 42 U.S.C. 1997e(a), prescribed by the institution. The Jail requires prisoners to file grievances within 15 days of an “incident, problem, or event” and to appeal any adverse decision. Turnage filed a grievance on September 27 and filed an immediate appeal after that grievance was denied. The district court dismissed his suit, observing that Turnage could have filed a grievance when he was forced to take an upper bunk.The Seventh Circuit reversed the dismissal. Turnage encountered a “problem” on August 30 but he experienced an “incident” on September 21; these were separate occasions for grievances. A grievance that is timely with respect to an injury satisfies section 1997e(a) when the suit seeks damages for that injury. View "Turnage v. Dart" on Justia Law

The issue this case presented for the Pennsylvania Supreme Court's review centered on whether the Commonwealth Court erred in concluding that Firearm Owners Against Crime (FOAC), Kim Stolfer, Joshua First, and Howard Bullock (collectively, Appellees) had individual and associational standing to challenge four of the City of Harrisburg’s ordinances regulating firearms: the Discharge, Parks, Lost/Stolen, and Minors Ordinances. Americans and co-conspirators based in China schemed to obtain EB-1C work visas fraudulently for Chinese nationals. Their clients each deposited about $300,000 into a client-owned American bank account. The government did not prosecute the Chinese clients but sought forfeiture of the funds. The Chinese nationals filed claims for the funds.The State Department denied visa requests to allow certain Chinese nationals to attend the forfeiture trial. The U.S. Attorney unsuccessfully worked with their attorney and DHS to obtain parole letters granting them entry without a visa. The Chinese argued that their inability to attend violated the Due Process Clause by preventing them from presenting an “innocent owner” defense, 18 U.S.C. 983(d)(1). The district court denied the motion, noting other means to present their testimony, such as by video conference, and that counsel could present their defenses. All the Chinese were represented by counsel at trial; four attended and testified. The court instructed the jury that the government bore the burden of proving that the “funds made the . . . visa fraud scheme easy or less difficult or ensured that the scheme would be more or less free from obstruction or hindrance.”The jury found that the government had satisfied its burden of proof as to all the funds, that five Chinese nationals—four of whom had testified—had proved that they were innocent owners, and rejected the remaining innocent-owner defenses. Landlords challenged Part A of New York’s residential eviction moratorium statute, the COVID-19 Emergency Eviction and Foreclosure Prevention Act of 2020 (CEEFPA), and attempted to challenge the new residential eviction moratorium, (Subpart C(A) 2021), enacted in Sept. 2021, after several provisions of the old moratorium statute expired. The Supreme Court enjoined enforcement of Part A 2020 on August 12, 2021, based on due process defects.The Landlords argued that Subpart C(A) 2021 did not remedy the defect but is merely a continuation of the previous statute. State officials sought dismissal of the appeal as moot, arguing that the challenged provisions of the old statute have expired, Subpart C(A) 2021 does remedy the defect identified by the Supreme Court, and any challenge to the 2021 provisions must be brought in a new lawsuit.The Second Circuit concluded that the due process claims are moot, dismissed them, and remanded the case. With the appeal remanded, the court concluded it lacked jurisdiction to enjoin enforcement of Subpart C(A) 2021. The “mootness is attributable to a change in the legal framework,” so the Landlords “may wish to amend their complaint so as to demonstrate that the repealed statute retains some continuing force or to attack the newly enacted legislation.” View "Chrysafis v.
