The court awarded Plaintiff fees after he prevailed on one of his six causes of action against his former employer ExakTime Innovations, Inc., on his complaint for disability discrimination under the Fair Employment and Housing Act (FEHA) and related causes of action. The jury awarded Plaintiff $130,088 in damages on his claim ExakTime failed to engage in a good faith interactive process with him. Plaintiff appealed from the trial court’s order awarding him $686,795.62 in attorney fees after the court applied a .4 negative multiplier to its $1,144,659.36 adjusted lodestar calculation “to account for [p]laintiff’s counsel’s . . . lack of civility throughout the entire course of this litigation.” Plaintiff contends the $457,863 reduction in attorney fees based on his counsel’s incivility must be reversed.   The Second Appellate District affirmed. The court agreed with the trial court that it may consider an attorney’s pervasive incivility in determining the reasonableness of the requested fees. A court may apply, in its discretion, a positive or negative multiplier to adjust the lodestar calculation—a reasonable rate times a reasonable number of hours—to account for various factors, including attorney skill. The court explained that the record amply supports the trial court’s finding that Plaintiff’s counsel was repeatedly, and apparently intentionally, uncivil to defense counsel—and to the court— throughout the litigation. Three private contractors providing war-zone security services to the Department of Defense (DOD) appealed a district court order remanding to Nevada state court this suit brought by a group of their employees who guarded DOD bases, equipment, and personnel in Iraq. The guards alleged that their working conditions violated the contractors’ recruiting representations, their employment contracts, and the Theater Wide Internal Security Services II (TWISS II) contract between the contractors and the Department of Defense.The Ninth Circuit reversed. The panel held that the contractors met the limited burden imposed by the federal officer removal statute, 28 U.S.C. Section 1442(a)(1), which permits removal of a civil action against “any officer (or any person acting under that officer) of the United States or of any agency thereof . . . for or relating to any act under color of such office.” To satisfy this requirement, a removing private entity must show that (a) it is a “person” within the meaning of the statute; (b) there is a causal nexus between its actions, taken pursuant to a federal officer’s directions, and the plaintiff’s claims; and (c) it can assert a colorable federal defense. There was no dispute that the contractors, as corporations, were “persons” for purposes of Section 1442(a)(1). BioCorRx, Inc. (BioCorRx) was a publicly traded company primarily engaged in the business of providing addiction treatment services and related medication. It issued several press releases that allegedly made misrepresentations and improperly disclosed confidential information about a treatment it was developing for opioid overdose. VDM Biochemicals, Inc. (VDM) specializes in the synthesis and distribution of chemicals, reagents, and other specialty products for life science research. It owned a patent (the patent) for VDM-001, a compound with potential use as a treatment for opioid overdose. In September 2018, VDM and BioCorRx entered into a Mutual Nondisclosure & Confidentiality Agreement (the NDA), which restricted each party’s disclosure of confidential information as they discussed forming a business relationship. A month later, VDM and BioCorRx signed a Letter of Intent to Enter Definitive Agreement to Acquire Stake in Intellectual Property (the letter of intent). The letter of intent memorialized the parties’ shared desire whereby BioCorRx would partner with VDM to develop and commercialize VDM-001. BioCorRx and VDM never signed a formal contract concerning VDM-001. Their relationship eventually soured. BioCorRx filed a complaint (the complaint) against VDM; VDM cross-complained. In response, BioCorRx filed the anti-SLAPP motion at issue here, seeking to strike all the allegations from the cross-complaint concerning the press releases. The Court of Appeal found these statements fell within the commercial speech exemption of California's Code of Civil Procedure section 425.16 (the anti-SLAPP statute) because they were representations about BioCorRx’s business operations that were made to investors to promote its goods and services through the sale of its securities. Since these statements were not protected by the anti-SLAPP statute, the Court reversed the part of the trial court’s order granting the anti-SLAPP motion as to the press releases. The Eleventh Circuit reversed the district court’s grant of qualified immunity following Plaintiff’s Section 1983 false arrest claim and a state law false arrest claim against two Huntsville, Alabama police officers and the City itself. Plaintiff brought both a Section 1983 false arrest claim and a state law false arrest claim against two Huntsville, Alabama, police officers and the City itself. After the district court concluded that the officers were entitled to qualified immunity because they had arguable probable cause to arrest Plaintiff, he appealed.   The Eleventh Circuit reversed the district court’s grant of summary judgment. The court explained that the officers violated Plaintiff’s clearly established Fourth Amendment rights when they arrested him with neither actual nor arguable probable cause. The district court dismissed Plaintiff’s state law claims against Defendants because it determined that arguable probable cause was a defense to those claims as well. The court wrote that the district court did not conduct any independent analysis of these claims and instead linked its decision directly to the finding of arguable probable cause on the federal claims. There was no actual probable cause to conclude that Plaintiff was driving a car without displaying his license at the time the officer arrived. Nor could any reasonable officer interpret the law as permitting arrest in this case, and therefore there was no arguable probable cause either. This is an appeal from an order granting Defendants Seyfarth Shaw LLP (Seyfarth) and Colleen Regan a portion of the fees they requested pursuant to Code of Civil Procedure section 425.161 (the anti-SLAPP2 statute) and resulting judgment. The trial court awarded the fees without finally ruling on Defendants’ anti-SLAPP motion to strike. Plaintiffs immediately thereafter dismissed their complaint. Plaintiffs appealed the fee award on three general theories. Defendants cross-appealed. They argue the trial court should have awarded all the fees they requested, not just a portion of those fees, because all of Plaintiffs’ claims were based on conduct protected by the anti-SLAPP statute, no exceptions applied, and their request was reasonable.   The Second Appellate District affirmed in part and reversed in part. The court explained that it agreed with Defendants that their motion to strike was wholly meritorious and their fee request therefore should not have been reduced on the grounds that they would have prevailed only partially on their motion. The court disagreed with Plaintiffs that the trial court erred in the ways they claimed. The court explained that under Coltrain, Defendants prevailed because plaintiffs dismissed their suit and failed to show it was for reasons unrelated to lack of merit. Plaintiff’s son spent several months at a medium-security facility in St. Louis called “the Workhouse.” None of the guards saw Plaintiff’s son receive or take fentanyl, the drug that killed him. Inmates tried to help by rubbing ice on him once he lost consciousness. Upon arriving a few minutes later, three Officers radioed for medical assistance. In the meantime, rather than try to resuscitate Plaintiff’s son themselves, they stood by and watched as two inmates tried to help him. When trained medical personnel finally arrived four minutes later, it was too late: they were unable to revive Plaintiff’s son, who died from an overdose. Surveillance footage captured some, but not all, of these events. Plaintiff’s mother sued the City of St. Louis, the three responding officers, and two supervisors for their deliberate indifference. The district court denied summary judgment to the responding officers.   The Eighth Circuit vacated and remanded. The court held that the district court misstated the burden and relied on allegations from an unverified complaint to deny summary judgment. The court wrote that the district court erred in how it dealt with the gaps in the video footage. Instead of relying on other evidence to fill in the missing details, the findings mirrored what the plaintiff’s unverified complaint said. The court wrote that unsworn allegations are no substitute for evidence at summary judgment. The court explained that the district court tilted the scales too far in the Plaintiff’s favor by raising the summary-judgment burden on the officers and allowing unsworn allegations to rebut evidence. Defendant asserts that he is required by his religious faith to abstain from psychiatric medication. Defendant raised a religious objection to being involuntarily medicated without identifying a particular source of law. The district court denied the objection, concluding that: (1) the Government had a compelling interest in prosecuting Defendant’s crime, which was not outweighed by Defendant’s religious liberty interests; and (2) the Government satisfied the four Sell factors. Defendant appealed.   The Fifth Circuit vacated the district court’s order and remanded. The court explained that Defendant faces a pending civil-confinement hearing in North Carolina. Moreover, he asserts that his religious belief as a Jehovah’s Witness prevents him from taking medication. He further asserts that forcible medication would violate his “constitutionally protected liberty.” The Government does not dispute that Defendant’s religious faith can qualify as a “special factor” under Sell. See Red Br. at 13–15; cf. Ramirez v. Collier, 595 U.S. 411, 426 (2022). Defendant’s religious beliefs, combined with his lengthy detention and his potential civil confinement, thus lessen the Government’s interests under the first Sell factor. The court emphasized that it holds only that religious liberty can constitute a “special circumstance” under Sell and that Defendant properly raised a religious objection to forcible medication here. That well-taken special circumstance, combined with other factors identified above, necessitates the district court’s reevaluation of the Government’s efforts to forcibly medicate him. View "USA v. This case presents the questions of what Defendant must prove to establish affirmative defenses to pay-discrimination claims under federal and state laws: the Equal Pay Act (“EPA”) and New York Labor Law Section 194(1). Plaintiff alleged that Defendant Culinary Institute of America, violated these equal-pay laws by compensating her less than a male colleague. The Culinary Institute responded that a “factor other than sex”—its sex-neutral compensation plan, which incorporates a collective bargaining agreement—justifies the pay disparity. Plaintiff argued that the compensation plan cannot qualify as a “factor other than sex” because it creates a pay disparity unconnected to differences between her job and her colleague’s job. The district court did not consider the divergent requirements imposed by the EPA and Section 194(1) when assessing Plaintiff’s claims and the Culinary Institute’s defense.   The Second Circuit affirmed in part, vacated in part, and remanded insofar as the district court granted summary judgment for Defendant on the Section 194(1) claim. The court explained that Plaintiff’s position that a “factor other than sex” must be job-related is incorrect as to the EPA. The plain meaning of the EPA indicates the opposite. The court held that to establish the EPA’s “factor other than sex” defense, a defendant must prove only that the pay disparity in question results from a differential based on any factor except for sex. But Plaintiff’s position is correct as to New York Labor Law Section 194(1). A recent amendment to Section 194(1) explicitly added a job-relatedness requirement. View "Eisenhauer v. Plaintiff is an Idaho prisoner facing execution by lethal injection. He challenged Idaho’s execution practices. He alleged that these practices: 1) interfere with his ability to challenge the State’s method of execution as cruel and unusual punishment; 2) inhibit his ability to seek clemency; 3) inflict mental anguish; 4) increase the risk of an unconstitutionally painful execution; 5) treat similarly situated prisoners unequally; 6) violate the separation of powers under the Idaho Constitution; and 7) contravene Idaho Code Section 19-2716’s requirement that the director of the Idaho Department of Correction (IDOC) establish procedures governing executions. On remand, and in light of then-co-plaintiff’s scheduled execution, the district court sua sponte dismissed the complaint for failure to state a claim under Federal Rule of Civil Procedure (“Rule”) 12(b)(6).   The Ninth Circuit affirmed in part, vacated in part, and remanded. The court rejected Plaintiff’s contention that the district court violated the rule of mandate by denying leave to amend in connection with the Rule 12(b)(6) dismissal of the complaint. The court explained that although its decision in Pizzuto I noted parenthetically that Plaintiff should be permitted to amend the complaint, the court did not foreclose the district court’s sua sponte dismissal of the complaint or address whether, in connection with such a dismissal, further amendment would be futile. The court agreed with the district court that amendment of several of Plaintiff’s claims would be futile. The court therefore affirmed the dismissal with prejudice of the First Amendment claims based on access to execution-related information. View "THOMAS CREECH, ET AL V. Plaintiff Van Sant & Co. (Van Sant) owned and operated a mobile home park in Calhan, Colorado, for a number of years. In 2018, Van Sant began to publicly explore the possibility of converting its mobile home park to an RV park. In October 2018, Calhan adopted an ordinance that imposed regulations on the development of new RV parks, but also included a grandfather clause that effectively exempted the two existing RV parks in Calhan, one of which was connected to the grandparents of two members of Calhan’s Board of Trustees (Board) who voted in favor of the new RV park regulations. Van Sant subsequently filed suit against Calhan, several members of its Board, the owners of one of the existing RV parks, and other related individuals. asserting antitrust claims under the Sherman Act, as well as substantive due process and equal protection claims under 42 U.S.C. § 1983. The defendants successfully moved for summary judgment. Van Sant appealed, but finding no reversible error, the Tenth Circuit affirmed. View "Van Sant & Co. v. Town of Calhan, et al." on Justia Law
