The fathers of minor children in New Jersey challenged the state law governing child custody proceedings between New Jersey parents. In a suit against state court judges, under 42 U.S.C. 1983, they argued that the “best interests of the child” standard that New Jersey courts use to determine custody in a dispute between two fit parents is unconstitutional. The fathers alleged that their parental rights were restricted, or that they were permanently or temporarily separated from their children, by order of the New Jersey family courts without adequate notice, the right to counsel, or a plenary hearing, i.e. without an opportunity to present evidence or cross-examine and that although mothers and fathers are, in theory, treated equally in custody disputes under New Jersey law, in practice courts favor mothers. The Third Circuit affirmed dismissal of the suit, after holding that the Rooker-Feldman doctrine did not bar the suit, which was not challenging the state court judgments, but the underlying policy that governed those judgments. Consolidated appeals arose out of a complaint filed by four Georgia taxpayers in which they challenged the constitutionality of Georgia’s Qualified Education Tax Credit, Ga. L. 2008, p. 1108, as amended (“HB 1133” or the “Bill”). HB 1133 set up a tax credit program that allows individuals and businesses to receive a Georgia income tax credit for donations made to approved not-for-profit student scholarship organizations (“SSOs”). The Bill created a new tax credit statute for that purpose. Generally speaking, the SSO is required to distribute the donated funds as scholarships or tuition grants for the benefit of students who meet certain eligibility requirements, and the parent or guardian of each recipient must endorse the award to the accredited private school of the parents’ choice for deposit into the school’s account. Plaintiffs alleged: (1) the Program was educational assistance program, and the scheme of the Program violated the Constitution; (2) the Program provided unconstitutional gratuities to students who receive scholarship funds under the Program by allowing tax revenue to be directed to private school students without recompense, and also that the tax credits authorized by HB 1133 resulted in unauthorized state expenditures for gratuities; (3) the Program took money from the state treasury in the form of dollar-for-dollar tax credits that would otherwise be paid to the State in taxes, and since a significant portion of the scholarships awarded by the SSOs goes to religious-based schools, the Program takes funds from the State treasury to aid religious schools in violation of the Establishment Clause; and (4) the Department of Revenue violated the statute that authorized tax credits for contributions to SSOs by granting tax credits to taxpayers who have designated that their contribution is to be awarded to the benefit of a particular individual, and by failing to revoke the status of SSOs that have represented to taxpayers that their contribution will fund a scholarship that may be directed to a particular individual. Plaintiffs sought mandamus relief to compel the Commissioner of Revenue to revoke the status of SSOs, and injunctive relief against the defendants to require them to comply with the constitutional provisions and statutory laws set forth in the complaint. In addition to mandamus relief and injunctive relief, plaintiffs sought a declaratory judgment that the Program was unconstitutional. The Georgia Supreme Court found no error in the trial court’s finding plaintiffs lacked standing to pursue their constitutional claims, or their prayer for declaratory relief with respect to those claims, either by virtue of their status as taxpayers or by operation of OCGA 9-6-24. Jewels by Park Lane, Inc. ("JBPL"), and Kathy Cassidy, the national director for JBPL, sought a writ of mandamus compelling the Circuit Court to vacate its order denying their motion to dismiss an action against them on the ground of improper venue arising out of a forum-selection clause, and to enter an order dismissing the case. JBPL was a multilevel marketing company that sold jewelry through independent contractors who host parties offering JBPL's jewelry line for sale. Jennifer Miller became a “director” for LBPL. Miller sued JBPL and Cassidy, alleging JBPL promised to employ her for a 12-month period and to pay her $4,000 a month for that period. Miller set out claims alleging account stated, open account, breach of contract, and fraud. Miller sought compensatory damages, punitive damages, and attorney fees. The employment agreement contained a “forum selection clause” in which any disputes between the parties would be settled in accordance with the laws of Illinois. Miller admitted that the director agreement contained a forum selection clause but argued that she would not have entered into the agreement but for the fraud perpetuated by JBPL and Cassidy. The Alabama Supreme Court concluded JBPL and Cassidy have shown a clear legal right to have the action against them dismissed on the basis that venue in the Tallapoosa Circuit Court was, by application of the outbound forum-selection clause, improper. MGM filed suit claiming that Special Act 15‐7 of the Connecticut General Assembly placed it at a competitive disadvantage in the state's gaming industry. The Act creates a special registration pathway for the state's two federally recognized Indian tribes to apply to build commercial casinos on non‐Indian land. The Second Circuit affirmed the district court's dismissal of the complaint, holding that any competitive harms imposed by the Act were too speculative to support Article III standing. Plaintiffs were families with children enrolled in the Douglas County School District RE-1 (“DCSD”) and the American Humanist Association (“AHA”). Plaintiffs filed suit challenging various DCSD practices as violations of the Establishment Clause and the Equal Access Act (“EAA”), contending DCSD engaged in a pattern and practice of promoting Christian fundraising efforts and permitting faculty participation in Christian student groups. The Tenth Circuit found most of the plaintiffs failed to demonstrate that they or their children experienced “personal and unwelcome contact with government-sponsored religious” activities. Furthermore, they failed to demonstrate their case for municipal taxpayer standing because they could not show expenditure of municipal funds on the challenged activities. The sole exception is plaintiff Jane Zoe: she argued DCSD violated the Establishment Clause when school officials announced they were “partnering” with a Christian student group and solicited her and her son for donations to a “mission trip.” The district court held that because Zoe’s contacts with the challenged actions were not conspicuous or constant, she did not suffer an injury for standing purposes. The Tenth Circuit found "no support in our jurisprudence" for the contention that an injury must meet some threshold of pervasiveness to satisfy Article III. In consolidated cross-appeals, the Pennsylvania Supreme Court accepted review to consider whether three statutory provisions, the “Donated or Dedicated Property Act” (“DDPA”), the “Project 70 Land Acquisition and Borrowing Act” (“Project 70 Act”), and the Eminent Domain Code, allow Appellant Downingtown Borough (“Borough”) to sell four parcels of land to private housing developers , Appellants Progressive Housing Ventures, LLC and J. Loew and Associates, Inc. (“Developers”). The four parcels comprised a public community park owned and maintained by the Borough, and were held by the Borough as trustee. After review, the Court vacated the order of the Commonwealth Court with respect to the Borough’s proposed sale to Developers of two southern parcels, reversed the order regarding the proposed sale by the Borough to Developers of two northern parcels, and reversed the order of the Commonwealth Court involving the Borough’s grant of easements to Developers over all parcels. The Borough was required to obtain court approval before selling the parcels, and easements over the land would have subordinated public rights to the parcels to private rights. The constitutional doctrine of sovereign immunity forbids Georgia courts to entertain a lawsuit against the State without its consent. This case began in 2012, not long after the adoption of House Bill 954, which concerned medical procedures for the termination of pregnancies. Eva Lathrop, Carrie Cwiak, and Lisa Haddad are physicians licensed to practice in Georgia. In their petition, the plaintiff-physicians alleged that House Bill 954 violated the Georgia constitution in several respects. Based on their allegations, the plaintiff-physicians sought a declaratory judgment that certain provisions of House Bill 954 were unconstitutional, and they sought injunctive relief to restrain the defendant-state officers from enforcing House Bill 954. The trial court granted a motion to dismiss these claims, and the plaintiff-physicians appealed dismissal of their petition. The Georgia Supreme Court held that the doctrine of sovereign immunity extends generally to suits against the State, its departments and agencies, and its officers in their official capacities for injunctive and declaratory relief from official acts that are alleged to be unconstitutional. In so holding, however, the Court recognized the availability of other means by which aggrieved citizens may obtain relief from unconstitutional acts, including prospective relief from the threatened enforcement of unconstitutional laws. Without alleging a defendant purposefully availed itself of the privilege of doing business in Washington, thus invoking the benefits and protections of Washington laws, exercising jurisdiction would not comport with due process. Special Electric Company Inc. asked the Washington Supreme Court to reverse the Court of Appeals because that court found Washington could exercise specific personal jurisdiction over Special Electric under a stream of commerce theory without any allegation that Special Electric purposefully availed itself of Washington's laws. Because the parties and trial court did not have the benefit of the Court’s recent decision in Washington v. LG Electronics, Inc., 375 P.3d 1035 (2016), cert. denied, 137 S. Ct. 648 (2017), or the recently disclosed evidence of Special Electric' s unrelated contacts in Washington, the Supreme Court remanded this case back to the trial court for reconsideration. The Court accepted review in this case, however, because it disagreed with the Court of Appeals' application of “LG Electronics,” and this case offered an opportunity for the Supreme Court to give guidance to the lower courts on what a plaintiff must allege for specific personal jurisdiction. Three appeals arose from two cases that concerned the passage, implementation, and alleged effects of Amendment 64 to the Colorado Constitution, Colo. Const. art. XVIII, section 16. Amendment 64 repealed many of the State’s criminal and civil proscriptions on “recreational marijuana,” and created a regulatory regime designed to ensure that marijuana was unadulterated and taxed, and that those operating marijuana-related enterprises were, from the State’s perspective, licensed and qualified to do so. The three appeals at issue and two related motions to intervene raised four principal disputes stemming from the alleged conflict between the federal Controlled Substances Act (CSA), under which manufacturing, distributing, selling, and possessing with intent to distribute marijuana remained illegal in Colorado. Essentially, the parties disputed whether Amendment 64 was preempted by the CSA. The Tenth Circuit's conclusions regarding the preemption claims did not require it to reach that question. The Court therefore did not decide whether the CSA preempted any aspect of Amendment 64, or Colorado and Pueblo County’s laws or regulations. This case involved challenges to the City of Atlanta’s attempted annexation of five areas. Shortly after the Governor approved HB 514 on April 26, 2016, Atlanta received petitions for annexation from five unincorporated areas of Fulton County contiguous to Atlanta. Emelyn Mays and five other individuals (collectively, “Mays”), who represented each of the proposed annexation areas as residents or property owners, filed a petition for declaratory judgment challenging the annexations. The trial court held an evidentiary hearing, and shortly thereafter issued an order granting Mays’s request declaring the annexations null and void on the ground that they were untimely under the terms of HB 514 and thus the Communities were part of South Fulton. In reaching this conclusion, the court expressly rejected Atlanta’s contention that HB 514 unconstitutionally conflicted with the general laws governing annexation by municipalities by preventing Atlanta’s annexation of the Communities as of July 1, 2016. Atlanta appealed to the Georgia Supreme Court. The Supreme Court found the trial court correctly held that the annexations were invalid because at the time they would have become effective, the areas in question were already part of the newly incorporated City of South Fulton and thus ineligible for annexation by Atlanta.
