Pyle v. Woods
Defendant James Woods, a detective in the Cottonwood Heights Police Department, was informed by Utah’s Unified Fire Authority (“UFA”) that medications, including opioids and sedatives, were missing from several UFA ambulances. Detective Woods accessed a state database and searched the prescription drug records of 480 UFA employees in an effort to “develop suspect leads of those who have the appearance of Opioid dependencies.” Consistent with Utah law at the time, Woods did not obtain a search warrant before accessing the Database. Based on the information Woods obtained from the Database search, he developed suspicions about Plaintiffs Ryan Pyle and Marlon Jones. Neither Plaintiff, however, was ever prosecuted for the thefts from the ambulances. Plaintiffs brought separate lawsuits pursuant to 42 U.S.C. 1983, each challenging Defendants’ conduct as violative of the Fourth Amendment and the Fair Credit Reporting Act (“FCRA”). In both suits, the district court dismissed the claims against Defendant Woods, concluding Woods was entitled to qualified immunity because the law governing warrantless access to prescription drug information by law enforcement was not clearly established. The district court also dismissed the FCRA claims because Defendants’ actions fit within an exemption set out in the Act. In Jones’s suit, the district court dismissed the constitutional claims against the city of Cottonwood Heights with prejudice because Jones’s complaint failed to state a claim for municipal liability plausible on its face. In Pyle’s suit, the district court dismissed the constitutional claims against Cottonwood Heights without prejudice, concluding Pyle failed to notify the Utah Attorney General of those claims as required by Rule 5.1 of the Federal Rules of Civil Procedure. Pyle and Jones each appealed. Exercising jurisdiction pursuant to 28 U.S.C. 1291, and finding no reversible error, the Tenth Circuit Court of Appeals affirmed the district court’s judgments. Rozsavolgyi v. The City of Aurora
Rozsavolgyi filed a charge of discrimination on the basis of disability with the Illinois Department of Human Rights against the city of Aurora. Rozsavolgyi had been employed by the city from 1992 until she was involuntarily discharged in 2012. Months later, Rozsavolgyi was notified that she had the right to commence a civil action. Rozsavolgyi filed suit, alleging civil rights violations under the Illinois Human Rights Act, 775 ILCS 5/1-101, including failure to accommodate her disability, disparate treatment, retaliation, and hostile work environment. The circuit court certified three questions for permissive interlocutory review to the appellate court under Illinois Supreme Court Rule 308. After the appellate court addressed each question Rozsavolgyi obtained a certificate of importance under Rule 316 as to one question: Does the Local Government and Governmental Employees Tort Immunity Act, 745 ILCS 10/1, apply to a civil action under the Human Rights Act where the plaintiff seeks damages, reasonable attorneys’ fees, and costs? If yes, should the court modify, reject or overrule its prior holdings that the Tort Immunity Act applies only to tort actions and does not bar actions for constitutional violations? The Illinois Supreme Court vacated and remanded the appellate court’s response. The question is “improperly overbroad, should not have been answered, and does not warrant” review. The question ignores the breadth of the Human Rights Act, which provides for numerous types of civil actions for unlawful conduct in a variety of contexts. View "Rozsavolgyi v. Satterfield v. District Attorney Philadelphia
Despite repeatedly asserting his innocence, Satterfield was convicted of first-degree murder in 1985 and sentenced to life in prison. After years of direct and collateral litigation, the district court, acting on his habeas petition, found that his ineffective assistance of counsel claim meritorious. The Third Circuit reversed, finding his petition barred by Antiterrorism and Effective Death Penalty Act’s (AEDPA’s) one-year statute of limitations, 28 U.S.C. 2244(d)(1). Years later, the Supreme Court decided, in McQuiggin v. Perkin, that a petitioner who can make a credible showing of actual innocence can overcome that limitations period. Satterfield sought relief from the judgment denying his habeas petition, characterizing McQuiggin’s change in law as an extraordinary circumstance to justify relief under FRCP 60(b)(6). The district court denied Satterfield’s motion. The Third Circuit vacated, holding that changes in decisional law may, under certain circumstances, justify Rule 60(b)(6) relief. “A district court addressing a Rule 60(b)(6) motion premised on a change in decisional law must examine the full panoply of equitable circumstances in the particular case.” In this case, the court did not articulate the requisite equitable analysis. If Satterfield can make the required credible showing of actual innocence, an equitable analysis would weigh heavily in favor of deeming McQuiggin’s change in law, as applied to Satterfield’s case, an exceptional circumstance justifying Rule 60(b)(6) relief. F.E.V. v. City of Anaheim
Adolf Gonzalez was shot and killed in an incident with two Anaheim police officers. Plaintiffs were the Decedent’s mother and minor daughter, who filed a complaint in federal court against the City of Anaheim (the City) and the two officers (collectively, Defendants). The Federal Complaint ("F.E.V. I") asserted four claims for violation of civil rights pursuant to title 42 United States Code section 1983 and state law claims for false arrest/false imprisonment, battery, negligence, and violation of the Bane Act, Civil Code section 52.1. The federal district court granted summary judgment in favor of defendants on the civil rights claims, and declined to exercise supplemental jurisdiction over the state law claims, dismissing them without prejudice. Following that dismissal, Plaintiffs filed a State Complaint, which overlapped the Federal Complaint, but provided more detail. After the Court of Appeal held oral argument in the prior appeal, the Ninth Circuit Court of Appeals issued its panel opinion in Gonzalez v. City of Anaheim, 2013 U.S.App. Lexis 9607, affirming F.E.V. I. On its own motion, the Court of Appeal took judicial notice of that opinion, which confirmed what would have been the outcome based on the status of the judgment at the time of oral argument. Based on Hernandez v. City of Pomona, 46 Cal.4th 501 (2009), the Court of Appeal held that the federal court judgment collaterally estopped Plaintiffs from pursuing their state law causes of action based on both the shooting and on theory the officers’ conduct before the shooting was negligent, and their battery and false arrest/false imprisonment causes of action. Nine months after we issued our opinion, the Ninth Circuit issued its en banc opinion reversing the federal court judgment as to claims of excessive force. In February 2015, Plaintiffs filed a new complaint (the Second State Complaint) asserting the same five causes of action as in the first State Complaint. Plaintiffs filed a motion to vacate the prior state court judgment. The trial court denied the motion. Plaintiffs brought a petition for writ of mandate to challenge the order denying their motion to vacate the judgment. A panel of the Court of Appeal summarily denied the writ petition. Defendants demurred to the Second State Complaint on the ground the claims were barred by collateral estoppel, jurisdiction, and the applicable statute of limitations. After oral argument, the trial court sustained the demurrer without leave to amend. The Court of Appeal found: (1) the Ninth Circuit en banc opinion did not nullify F.E.V. I; (2) plaintiffs could not collaterally attack the judgment affirmed by F.E.V. I; and (3) it would have been manifestly unjust to give claim preclusion effect to the judgement affirmed by F.E.V. I. Sanchez v. Moniz
While reading a daily report aloud to his colleagues, Sigiefredo Sanchez mixed up the order of words and numbers, skipped over sections, and gave briefing points out of order. Sanchez was unaware he had a reading disorder. Because his job required him to provide transportation information to nuclear convoys, his reading disorder presented a potential threat to national safety. Once diagnosed, Sanchez lost his safety-and-security clearance. Then, after unsuccessfully requesting accommodations, Sanchez was fired. Sanchez sued his former employer for due-process and Rehabilitation Act violations. The district court granted judgment on the pleadings and dismissed Sanchez’s claims, relying in part on the Supreme Court’s decision in Department of the Navy v. Egan, 484 U.S. 518 (1988). District courts lack jurisdiction to review the merits or motives of a decision to revoke or deny a security clearance. Egan applies when an agency has made (1) a security-clearance decision that (2) a plaintiff attempts to challenge. Sanchez argued the district court: (1) abused its discretion by denying Sanchez’s Motion to Supplement; (2) failed to accept Sanchez’s well-pleaded allegations and made findings of fact contrary to the complaint’s allegations; (3) erred in holding that Egan prohibited the court from reviewing Claim 1, the failure-to-accommodate claim; (4) erred in holding that the Department isn’t required to reassign disabled employees; and (5) improperly dismissed Claim 4, Sanchez’s procedural-due-process claim. The Tenth Circuit reversed in part, affirmed in part the district court's order, vacating the district court's judgment on the pleadings as to Claim 1 (failure-to-accommodate), but affirmed with respect to dismissal of claims 2-4 (the retaliation, disparate treatment, and procedural-due- process claims) as well as the district court’s order denying Sanchez’s Motion to Supplement. Williams v. Libertarian Party
Gordon Roy Butt sought to run for Colorado senate for the Libertarian Party in a 2013 recall election. The Secretary of State denied his request to circulate a petition because his request came after the deadline as then set by section 1-12-117(1). Butt and the Libertarian Party (collectively, “the Party”) sued the Secretary under section 1-1-113, C.R.S. (2017), alleging that the statutory deadline conflicted with the Colorado Constitution. Within the section 1-1-113 proceeding, the Party also raised a claim for relief under 42 U.S.C. 1983 (2012), and an accompanying request for an award of attorney’s fees under 42 U.S.C. 1988 (2012), alleging, inter alia, a First Amendment violation. The district court found for the Party on the state constitutional claim, and did not address the section 1983 claim. After the Colorado Supreme Court denied appellate review on a split vote, further proceedings occurred before the district court. The case was appealed once again, and the Supreme Court denied review again. Nine months later, the Party returned to district court seeking summary judgment on its section 1983 claim and, in the alternative, an attorney’s fee award under section 1988 on the ground that the Party had been successful on its state constitutional claim. The district court denied the Party’s request for attorney’s fees, finding that it had not pursued fees in a timely manner. It also dismissed the section 1983 claim as moot due to the General Assembly’s 2014 amendment of section 1-12-117(1). The court of appeals reversed the district court, holding that although the Party’s section 1983 claim was moot, the request for attorney’s fees under section 1988 was appropriate so long as the section 1983 claim was substantial, stemmed from the same nucleus of operative facts as the state constitutional claim, and was reasonably related to the plaintiff’s ultimate success. The court remanded the case to the district court to apply this test to determine whether the Party was entitled to fees. The Colorado Secretary of State appealed, and the Supreme Court reversed: a section 1983 claim may not be brought in a section 1-1-113 proceeding. The language of that section repeatedly refers to "this code," meaning the Colorado Election Code. Therefore, a section 1-1-113 proceeding is limited to allegations of a “breach or neglect of duty or other wrongful act” under the election code itself. § 1-1-113(1). We emphasize that Colorado courts remain entirely open for adjudication of section 1983 claims, including on an expedited basis if a preliminary injunction is sought, and that therefore section 1-1-113 does not run afoul of the Supremacy Clause. Frazier v. Williams
Ryan Frazier ran as a Republican candidate for United States Senate. After the Colorado Secretary of State determined that Frazier had not gathered enough sufficient signatures to appear on the ballot, Frazier challenged the Secretary’s determination under section 1-1-113, C.R.S. (2017), arguing that the Secretary improperly invalidated hundreds of signatures that substantially complied with the Colorado Election Code. Frazier also brought a claim under 42 U.S.C. 1983 (2012) arguing that certain Colorado statutes prohibiting non-resident circulators from gathering signatures violated the First Amendment. Frazier filed an accompanying request for attorney’s fees as authorized by 42 U.S.C. 1988 (2012). The district court ruled that the Secretary had properly invalidated certain signatures such that Frazier could not appear on the primary ballot. Frazier then appealed to the Colorado Supreme Court, which remanded for reconsideration of a number of signatures under the appropriate standard. On remand, the district court found that additional signatures substantially complied with the code, providing Frazier with sufficient signatures to appear on the Republican primary ballot for United States Senate. No ruling was made on Frazier’s section 1983 claim. Frazier then sought attorney’s fees pursuant to section 1988. The Secretary opposed the fee request, arguing that federal claims such as section 1983 may not be brought in summary proceedings under section 1-1-113. The district court disagreed, finding Frazier was entitled to an award of attorney’s fees. The Colorado Supreme Court held that where the language of section 1-1-113 allows a claim to be brought against an election official who has allegedly committed a "breach or neglect of duty or other wrongful act" under the Colorado Election Code, it refers to a breach of duty or other wrongful action under the Colorado Election Code, not a section 1983 claim. Wilson v. Illinois Department of Financial and Professional Regulation
In 1998, Dr. Wilson’s terminally ill patient was within hours of death. He was in pain and suffocating. Wilson concluded that the only possible palliation was unconsciousness. As Wilson was injecting a drug, the patient’s heart stopped. The coroner classified the death as murder. The Illinois Department of Financial and Professional Regulation summarily suspended Wilson’s medical license. The Department held a hearing in 2000. The coroner’s finding of homicide had been withdrawn; Wilson was not charged. His license was nonetheless suspended for five years. He sued in state and federal courts. Rather than staying proceedings, the federal court dismissed. Four times a state judge vacated the suspension. The Department reinstated its decision three times. Without a new hearing or explanation, the Department entered a new five-year suspension in 2007, and another in 2013. In 2014, the state court held that Wilson should not have been suspended for even one day. The Department did not reinstate Wilson’s license because he had not practiced during the last 17 years. In 2014 Wilson sought damages under 42 U.S.C. 1983. The district court held that the two-year statute of limitations had been running since 1998. The Seventh Circuit vacated. A federal challenge to a state administrative agency decision is not subject to an exhaustion-of-remedies rule but a claim never accrues until the plaintiff “has a complete and present cause of action”. The court noted the district court’s 1999 holding that Wilson could not litigate in federal court while state proceedings were ongoing; his section 1983 claim for damages did not accrue until 2014. Aviles-Rodriguez v. Los Angeles Community College District
In Romano v. Rockwell Int'l, Inc., 14 Cal.4th 479, the court held that under the Fair Employment and Housing Act (FEHA), Government Code section 12900 et seq., a party alleging that a discriminatory act led to the termination of his or her employment has until one year from the date the employment terminated to file an administrative claim. In light of Romano, the Court of Appeal held that the one year limitations period for plaintiff to file a timely Department of Fair Employment and Housing (DFEH) complaint began to run from the last day of his employment. Because he filed his DFEH complaint within that period, his claim was timely. Accordingly, the Court of Appeal reversed the dismissal of the third amended complaint. View "Aviles-Rodriguez v. Rubenstein v. Doe No. 1
In 2012, plaintiff filed suit against Doe No. 1, a public entity, alleging that she was molested by defendant's employee when she was a high school student from 1993-1994. After the claim was denied, she filed this instant action against Doe No. 1 and Doe Nos. 2-20, alleging that latent memories of the sexual abuse resurfaced in early 2012, when she was about 34 years old. The Supreme Court of California held that the 2012 claim was not timely in light of Shirk v. Vista Unified School Dist. (2007) 42 Cal.4th 201. The court explained that when the Legislature amended Code Civ. Proc., 340.1 without modifying the claims requirement, and later overruled Shirk, but only prospectively, it took measured actions that protected public entities from potential liability for stale claims regarding conduct allegedly occurring before January 1, 2009, in which the public entity had no ability to do any fiscal planning, or opportunity to investigate the matter and take remedial action.
